I approve the staffs proposals in SECY 97 304, subject to the following specific comments -
1.
I support the staffs proposal to continue to assess proposed new operstmg entities to d'etermine the applicability of 10 CFR 50.80 on a case-ty-case basis.

I have no objection to the staffs applying the preliminary criteria described in SECY 97-304 i
to proposals for now operating entities in the case-by-case assessments that the staff has Proposed.

I have no objection to the staffs action plan for the development of assessment criteria, but he nal critoria that the staff proposes for publication in a draft Regulatory Guide should be a

submitted to the Commisskn for approval before the draft Regulatory Guide is published.

In addition, I am concemed that the NRC may not have pianned for the loss of annual fees that will result when the Fort St. Vrain ISFSI license is transferred to a U.S. Govemment licensee. The staff should evaluate the annual fee situation in this case and recommend approaches, including proposals for legisiation, i
that would allow the NRC to recover annual fees from U.S. Govemment licensees.

STAFF REQUIREMENTS - SECY-97-304 - RESPONSE TO STAFF REQUIREMENTS MEMORANDUM: SECY 37-144,
' POTENTIAL POLICY ISSUES RAISED BY NJN-OWNER OPERATORS' The Commission has approved the staffs proposal to continue to assess new operating entities to determine the applicability of 10 CFR 50.80 on a case by-case basis and to develop final criteria for triggering a review under 10 CFR 50.80. The staff should continue to refine the criteria as experience is gained. (For example, the staff may want to consider as a review criterien, any agreement that provides control over the terms of employment for licensed staff.)
The staff should develop justification for each of the criteria so that the basis for triggering a license review is clearly understood by the industry. The proposed assessment criteria should be publish 3d in a draft Regulatory Guide after it is submitted to the Commission for approval.
