I I approve the staffs proposed action plan to develop final criteria on the review;of non-owner operator scenarios. I also have no objection to the staffs use of the preliminary criteria,
' described in SECY 97-304, in its cuse-by-case assessments. The staff should inform the Commision of the criteria that the staff proposes.to include in a draft Regulatory Guide prior to publication Lf the draft Regulatory Guide for comment.
I join in the recommendations of Commissioner McGaffigan that: 1. the staff provide recommendations on, and obtain the Commission's approval for, resolution of rfated issues regarding the Fort St. Vrain ISFSI license transfer; and,2. the staff recommend approaches that would allow the NRC to recover annual fees from Federal licensees.
