Dear Mr. Toelle:
By letter dated September 2,1997, you requested Nuclear Regulatory Commission approval to discontinue the current requirement of submitting reports of facility records reconciled with NMMSS generated M 742 reports to the cognizant Department of Energy (DOE) field office (Oak Ridge Operations) on a bimonthly basis. Further, you have proposed to reconcile facihty records with NMMSS generated M 742 reports a a semiannual basis following the March and September physicalinventories while maintair,ing the bimonthly submission of NRC Form 327 reports. The current reporting requirements are based on the latest wntten 00E requirements -
that were in effect before March 3,1997, and DOE Order 5633.39, as indicated in NRC's exemption letter dated April 30,1997, from Dr. Carl J. Paperiello to Mr. Robert Woolley.
The NRC staff has reviewed your request and has concluded that cessation of reporting to the cognizant DOE field office is appropriate since DOE discontinued its jurisdiction over USEC '
nuclear material on March 3,1997. Even though there are important and significant differences in the information contained in NRC Form 327 and M 742 reports, the staff has concluded that reducing the frequency, for reconciling facihty records with NMMSS generated M 742 reports, from bimonthly to semiannually, will not reduce the effectiveness of the Portsmouth (PORTS) ,
and Paducah (PGDP) safeguards programs and is consistent with the requirements of 10 CFR ,,
Part 74.13(a)(1). As such, effective December 1,1997, USEC is exempted from submitting g$
reports of facility generated inventory records reconciled with NMMSS generated M 742 reports to the cognizant DOE field office, which was previously required by NRC's April 30,1997, exemption letter. Further, effective December 1,1997, USEC is exempted from reconciling facility generated inventory records with NMMSS generated M 742 reports on a bimonthly basis, g which was previously required by NRC's April 30,1997, exemption letter, Instead, USEC shall i 1
reconcile facility generated inventory records with NMMSS generated M 742 reports for the
. semiannual periods ending on March 31 and September 30, of each year. This reconciliation will be completed within thirty days of the NMMSS M 742 report date. All other provisions contained in the April 30,1997, letter remain the same.
