Chairman Jackson's Comments on SECY-97-279 I approve the staffs recommendation to immediately initiate a rulemaking that would amend 10 CFR Part 51 to categorize the impacts of transportation of HLW as a Category 1 issue. As the staff points out in the paper, this option would conserve both Imensee and NRC resources by not requiring that the issue be addressed in each plant-specific environmental report.

I do not approve, at this time, the adoption of staff Option 2 that would require, in the near term, that the issue be addressed in an appicant's plant-specific environmental report, if, as the staff states in SECY-97-279, tne rulemaking can be completed in one year, there appears to be little need for the adoption of Option 2 A final amendment to 10 CFR Part Si could be in place in -

December,1998, it is unlikely that the NRC will issue a draft envirnnmental impact statement before December,1998 oven if a license renewal appiscation were submitted in earty 1998.

Furthermore, it would appear prudent to apply the results of the generic assessment of this issue to the first license renewal application rather than introducing the issue on a case-specific basis, if at a later date, it appears that the generic rv ; making is being delayed so that it might affect the licensing process for a license renewal, the Commission can revisit the feasibility of adopting Option 2 at that time,

i Commissioner Dieus' Comments on SECY-97-279 I approve staffs recommendation to implement Option 3 immediately as a long-term solution _ and to implement Option 2 if a license renewal application is received before the rulemaking activity is completed. The staff should immediately notify the Commission if their ongoing supplemental analysis no longer supports a reasonable technical and legal determination that transportation of HLW is a Category 1 issue and may be generically adopted in a license renewal application.

TAFF REQUIREMENTS - SECY-97-279 - GENERIC AND CUMULATIVE ENVIRONMENTAL IMPACTS OF TRANSPORTATION OF HIGH LEVEL WASTE (HLW) IN THE VICINITY OF AN HLW REPOSITORY (SRM M970612)

The Commission has approved the staffs proposal to implement Option 3 to amend 10 CFR 51.53(c)(3)(ii)(M) as a long-term solution to categorize the impacts of transportation of HLW as a Category 1 issue. The staffs proposal to require licensees to provide a discussion in the plant specific environmental report (Option 2) should be implemented only if a license renewal application is received before the rulemaking activity is completed and a delay due to the generic rulemaking might affect the licensing process for a license renewal. The staff should notify the Commission if implementation of Option 2 is later deemed necessary for this reason.
