RIVER BEND STATION, UNIT 1 - PETITION OF THE UNION OF CONCERNED SCIENTISTS (UCS) PURSUANT TO 10 CFR 2.206; NOTICE OF INFORMAL PUBLIC HEARING (TAC NO. MA3669)
Dear Mr. Edington:
By letter dated September 25,1998, David A. Lochbaum, acting on behalf of the Union of Concerned Scientists (UCS), submitted a Petition pursuant to 10 CFR 2.206 requesting that the River Bend Station (RBS) be immediately shut down and its operating license suspended or modified until the facility's design and licensing bases are updated to permit operation with failed fuel assembies or until all failed fuel assemblies are removed from the reactor core. In addition, the Petition requested an informal public hearing in the Washington, D.C. area to present new plant-specific information regarding the operation of RBS, as well as to discuss an April 2,1998, UCS report entitled " Potential Nuclear Safety Hazard / Reactor Operation With Failed Fuel Cladding." In a letter dated October 29,1998, the Nuclear Regulatory Commission (NRC) offered the Petitioner the opportunity to present the information on reactor operation with failed fuel assemblies at an informal public hearing. On November 6,1998, the Petitioner accepted the NRC's offer to conduct a hearing. Since that time, the NRC has consolidated the RBS Petition with a similar Petition filed for the Perry Nuclear Power Plant (PNPP), and decided that a joint informal public hearing will be held in the Washington, D.C. area to obtain relevant information regarding the issues raised by the Petitioner in the RBS and PNPP Petitions.
The purpose of this letter is to notify you that a date, time and location have been determined for the informal public hearing. The schedule was based upon input from EOi, UCS and FirstEnergy Nuclear Operating Co., the Perry licensee. The informal public hearing is scheduled as follows:
