Dear Ms. Torp:
This is In response to your letter dated December 4,1998, in which you requested information regarding the Nuclear Regulatory Commission's (NRC) policies and procedures for implementing the National Environmental Policy Act (NEPA) and National Historic Preservation Act (NHPA). Specifically, you asked for NRC guidance documents that define NEPA requirements for the preparation of Environmental Assessments (EAs) and Environmental Impact Statements (EISs), including categorical exclusions, and NHPA Section 106 compliance. In an attempt to be more responsive to your request, Rosetta Virgilio of my staff tried without success to contact you by telephone on December 21,1998. Not finding you in, Ms. Virgilio left a voice mall asking you to return the call so that the nature of your request can be better realized; otherwise, you run the risk of receiving voluminous documentation, some of which is in the process of being updated and which may not fully address your needs. In the interim, the following information is provided for your consideration.
Part 51,"E'wironmental Protection Regulations for Domestic Licensing and Related Regulatory Functions," of Title 10 of the Code of Federal Regulations (CFR) sets forth the NRC's policy and procedures for the preparation and processing of environmental impact statements and related documents pursuant to NEPA. Specifically, Subsection 51.22 notes the criterion for categorical exclusion or otherwise not requiring an environmental review. Part 51 of 10 CFR is approximately 50 pages long. Part 51 is available at NRC's web site, www.nre.aov. by going to
" News & Information" and then to "10 CFR."
NRC's Environmental Standard Review Plans (ESRPs) for Environmental Reviews of Nuclear Power Plants, NUREG-0555, contains sample ESRPs which constitute a series of instructions developed for NRC staff to use when conducting environmental reviews of applications related to nuclear power plants. Specifically, Section 2.5.3, Historic Properties, addresses the staff's need to comply with Section 106 of NHPA, i.e., identify and describe any historic, archeological, and traditional cultural resources and resu)s of consultation with the State Historic Preservation I
Officer; the results of any surveys and thelocation and significance of any properties that are listed in or eligible for inclusion in the National Register of Historic Places as a historic place; and any additional information. The ESRPs were issued in August 1997 as NUREG-1555, a draft report for public comment. Draft NUREG-1555 is expected to be issued in final in April 1999 following the address of public comments, it is approximately 350 pages long and is also available in CD format.
The ESRPs are only one of several sets of procedures used by NRC to meet its responsibilities under NEPA and NHPA. Other related documents that provide NRC guidance relevant to environmental and histodc preservation review
