SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NOS. 93 AND 80 TO FACILITY 0P RATING LICENSE NOS. NPF-76 AND NPF-80 HOUSTON LIGHTING & POWER COMPANY CITY PUBLIC SERVICt BOARD OF SAN ANTONIO CENTRAL POWER AND LIGHT COMPANY CITY OF AUSTIN. TEXAS DOCKET NOS. 50-498 AND 50-499 SOUTH TEXAS PROJECT. UNITS 1 AND_.Z l.0 INTRODUCTION By letter dated August 23, 1996, as supplemented by letters dated October 1 and 15, 1996, and January 28, 1997, Houston Lighting & Power Company (HL&P) requested approval of the transfer of operating authority under Facility Operating Licenses Nos. NPF-76 and NPF-80 for South Texas Project, Units 1 and 2 (STP) to a new operating company and issuance of conforming amendments, pursuant to 10 CFR 50.80 and 50.90. The proposed t ansfer of operating authority under the licenses would allow a new operating company to use and operate STP and to possess and use related licensed nuclear materials in accordance with the same conditions and authorizatians included in the current operating licenses. The proposed license amendments would reflect the transfer of operating authority.

The January 28, 1997, supplement provided clarifying information and did not change the initial no significant hazards consideration determination and did not expand the scope of the original application as noticed.

2.0 EVALUATION By Order Approving Application Regarding the Formation of an Operating Company and Transfer of Operating Authority, issued on April 8,1997, the Nuclear Regulatory Commission (NRC) consented to the transfer of the licenses with respect to authority to operate the facility, to the proposed new operating company, based on the findings discussed in the Order.

For administrative purposes, there is a need to amend the license to reflect the approved transfer.

Specifically, references to HL&P as a licensee are no longer applicable and are replaced by references to STP Nuclear Operating Company (STPNOC).

In addition, references to titles of management personnel of HL&P have been revised to reflect the corresponding titles used by STP110C. These amendments present no safety questions.

In consideration of the ftregoing, the staff finds the amendments acceptable.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Texas State official was notified of the proposed issuance of the amendments. The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

Pursuant to 10 CFR 51.21 and 51.35, an environmental assessment and finding of no significant impact was published in the Federal Reaister on November 18, 1996 (61 FR 58710).

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
