  • October 21,1997 EN 97499 UICE OF ENFORCEMENT NOTIFICATION CF SIGNIFICANT ENFORCEMENT ACTION Licensee: Omaha Public Power District (EA 97-432)

Fort Calhoun Station Docket No. 50-285 Subiect: PROPOSED IMPOSITION OF civil PENALTY - $110,000 This :s to inform the Commission that a Notice of Violation and Proposed Impesition of Civil Penalty in the amount of $110,000 will be issued on or about October 24,1997, to Omaha Public Power District. This action is based on a Severity Levellli problem involving the disabling of the containment spray system. Because this was not the first escalated enforcement action within 2

- years, the wtaif c.snsidered whether credit was warranted for identification and corrective action.

Credit was not warranted for identification because the error that resulted in the problem was revealed 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> later when an annunciator failed to clear following the. c.ompletion of a

. surveillance test, and there were several missed opportunities to identify the problem sooner.

Credit was warranted for corrective actions, which were prompt and comprehensive. However, discretion is being exercised to assess a penalty at twice tne base value because corrective actions for a previous escalated enforcement action should have preve.1ted this incident or resulted in it being discovered more promptly.

It should be noted that the licensee has not been specifically informed of the enforcement action.
