Reference is made to the Registrant's 1985 Form 10-K in item 1 under Fuel Supply-Nuclear and Regulation and Rates-Regulatlon, in Item 2 under Construction Program and in Item 8 under Note 10 to Financial Statements.
Reference is also made to the Registrant's Form 10-Q for the quart,er ended March 31, 1986 in Part 11, item 5 Texas Utilities Electric Company (Electric Company),
a subsidiary of the Registrant, is constructing two nuclear-fueled generating units at the Comanche Peak Steam Electric Station. Pursuant to a Joint Ownership Agreement, this project is jointly owned by Electric Company and Texas Municipal Power Agency (TMPA), Brazos Electric Power Cooperative, Inc. (BEPC) and Tex-La Electric Cooperative of Texas, Inc. (Tex-La).
On May 29, 1986, the Electric Company filed suit in the 14th Judicial District Court of Dallas County, Texas against TMPA, BEPC and Tex-La which own 6.2%, 3.8% and 2 1/6% of Comanche Peak, respectively, because of controversies which exist under the Joint Ownership Agreement with respect to the obligations of the parties.
Electric Company asserts that each of the defendants has either claimed that it has no further obligation to pay its share of the remaining costs of construction of Comanche Peak, or that Electric Company has failed to properly construct Comanche Peak or otherwise has breached its obilgations under the Joint Ownership Agreement.
Electric Company seeks recovery of damages against Tex-La for its anticipatory breach of the Joint Ownership Agreement and asks for a declaratory Judgment against Tex-La, BEPC and TMPA declaring among other things that they are obilgated to pay their share of the remaining costs of construction of Comanche Peak and that Electric Company has not failed to use prudent utility practices in constructing Comanche Peak in accordance with the Joint Ownership Agreement.
On May 30,1986, the Staff of the Nuclear Regulatory Commission (NRC) issued a Supplemental Safety Evaluation Report relating to Comanche Peak.
This report contains an evaluation of the comprehensive Program Plan being utilized by the Comanche Peak
Response
Team to address the outstanding design and construction concerns at Comanche Peak.
The report concludes that the Program Plan provides an overall structure and process for addressing and resolving all existing construction and design issues and any future issues that may be identified from further evaluations.
s In June 1986, Electric Company decided to no longer contest, and therefore paid, a civil penalty of $40,000 which was part of an aggregate of $120,000 in civil penalties previously proposed by the Staff of the NRC relating to allegations of harassment and intimidation at Comanche Peak.
Electric Company requested the Staff to revisit the other alleged violations to determine whether they did in fact occur and to consider mitigating the amount of the penalties.
