  1. OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION LigensAe: Duquesne Light Company (DLC) (EA 97-517)

Beaver Valley Power Station Units 1 and 2 Docket Nos. 50-334; 50-412 Sublect: PROPOSED IMPOSITlqN OF civil PENALTY $55,000 This is to inform the Commission that a Notice of Violation and Propesed imposition of Civil Penalty in the amount of $55,000 will be issued on or about January 6,1998 to DLC. This action is based on a violation involving the failure to take adequate action to correct a significant condition adverse to quality involving the high head safety injection (HHS1) pumps at both units.

The specific adverse condition involved voiding in the HHSI pumps suction lines which could lead to gas binding of the pumps and consequent failure to operate. The violation is classified at Severity Level 111.

Because this was not the first escalated enforcement action within the past 2 years, the staff considered whether credit was wananted for identification and corrective action. Credit was not warranted for identification because the violation was identified as a result of an event and DLC missed prior opportunities to identify that their corrr % actions to correct the gas banding condition had not been effective. Credit was wan..M<r. for corrective action because the corro.;tive actions were considered prompt and comprehensive.

It should be noted that the licensee hns not bec" specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice January 6,1998 Telephone Notification of Licensee January 6,1998 The Commonwealth of Pennsylvania, the State of Ohio, and the State of West Virginia will be notified.

The licensee has thirty days from the date of the Notice in which to respond Following NRC cvaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
