FITNESS FOR DUTY PROGRAMS (10 CFR 26) FOR MAINE YANKEE ATOMIC POWER STATION'
Dear Mr. Sellman:
By letter dated November 8,1997, Maine Yankee Atomic Power Company informed the U.S. Nuclear Regulatory Commission (NRC) that, based on the permanently shutdown status of the Maine Yankee Atomic Power Station (Maine Yankee) and your certifications of permanent cessation of power operation and permanent removal of fuel from the Maine Yankee reactor, the relevance of the Fitness for Duty Programs rule (10 CFR 26) has changed for Maine Yankee. You stated your understanding that with these certifications Maine Yankee no longer has to comply with 10 CFR Part 26.
The NRC staff has reviewed and evaluated your letter and its supporting information. The staff acknowledges that, due to the certificatior.s that you provided under 10 CFR 50.82(a)(1) regarding permanent cessation of operations and permanent removal of fuel from the reactor vessel, the Maine Yankee 10 CFR Part 50 license no longer authorizes operation of the reactor or emplacement of fuelinto the reactor vessel. Therefore, the staff concurs with your conclusion that 10 CFR Part ?6 no longer applies to Maine Yankee
.because 10 CFR Part 26 pertains to licensees authorized to operate a nuclear power reactor.
Regarding your request for an exemption from certain requirements of Part 26, you do not need an exemption because, as noted above, Part 26 is no longer applicable to your f acility.
