1.0 INTRODUCTION
. On March 14,1988, the staff issued a Safety Evaluation Report (SER) regarding PASNY's -
conf"rmance to Regulatory Guide (RG) 1.97 " Instrumentation for Light Water-Cooled Nuclear Power Piante to Assess Plant and Environs Conditions During and Following an Accident,"
Revision 2, for the James A. FitzPatrick Nuclear Power Plant. In that SER, the staff accepted the licensee's deviations from the guidance in RG 1.07 and found the post accident monitoring instrumentation to be acceptable, in submittels dated June 29,1995, and November 14,1997, the licensee identified as an
- i. additional deviation from RG 1.97 certain containment isolation valve position indication 3 instrumentation.
2.0 EVALUATION RG 1.97 recommends Category 1 position indication instrumentation for containment isolation valves. The licensee identified as a deviation from this recommendation, position indication
- . instrumentation for the transversing incore probe (TIP) system conteinment isolstion valves that do not meet the Category 1 environmental qualification criteria. However, Category 1
' instrumentation is not required for isolation valves'whose associated penetration flow path is isolated by at least one closed and deactivated automatic valve, closed manual valve, blind ,
- flange, or check valve with flow through the valve secured.
= The TIP systAm is used during reactor operation to calibrate the local power range monitors in
- the neutron monitoring ' system.~ The TIP system ball valves are 1) normally closed,2) fail closed -
on loss of power, and 3) are administratively controlled, if a containment isolation signal is .
' received while the TIP detector is inserted, the TIP system will automatically retract the detector s
' and close the valve.E In the event of a failure of the TIP detector to retract, or the ball valve to -
close, the shear valve can be remotely activated to cut the drive cable and seal the penetration. ~
Since these valves are 1) normally closed,2) fail closed, and 3) are administratively controlled, Category 1 position indication is not required. Therefore, the licensee's TIP ' system containment -
isolation valve position indication instrumentation is in conformance with RG 1.97 guidelines. ,

3.0 CONCLUSION
Based on review of the licensee's submittels, the staff finds that the licensee has provided adequate justification in accordance with the guidelines of RG 1,97 for not providing '
environmenially qualified instrumentation that monitors the TIP system containment isolation valve position at the James A. FitzPatrick Nuclear Power Plant. - Therefore, the staff concludes that the licensee's post accident monitoring instrumentation is acceptable,
