REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, MILLSTONE NUCLEAR POWER STATION, UNIT 1 (TAC NO. M96062)
Dear Mr. Carns:
By Northeast Nuclear Energy Company's (NNECO's) application dated September 3,1997, and Richard D. Meininger, President, CHAR Services, Inc.'s affidavit, NNECO submitted CHAR Services, Inc. Report CSR090, " Margin of Immunity Determination for SRV Electric Lift for Northeast Utilities, Millstone Nuclear Site, Unit 1," dated April 29,1996,and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
Mr. Melninger stated that the submit'ed information should be considered exempt from mandatory public disclosure for the following reasons:
1.
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of CHAR Services' competitors without license from CHAR Services constitutes a competitive economic advantage over other companies.
2.
The information consista of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage; e.g., by optimization or improved marketability.
3.
The information's use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
We have reviewed your application and the materialin accordance with the requirements of 10 CFR 2.790 and, on the basis of Mr. Meininger's statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
Therefore, the CHAR, Services, Inc. Report CSR090, " Margin of immunity Determination for SRV Electric Lift for Northeast Utilities, Millstone Nuclear Site, Unit 1," dated April 29, 1996, marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
