VOGTLE ELECTRIC GENERATING PLANT, UNITS 1 AND 2 -
RESPONSE TO REQUEST FOR RELIEF FROM THE ASME CODE, SECTION 111 REQUIREMENTS (TAC Nos. M96291 AND M96292)
Dear Mr. McCoy:
By letter dated July 11,1996, and pursuant to 10 CFR 50.55a(a)(3), Georgia Power Company (GPC) requested that the staff authorize relief from the 1974 Edition of the ASME Code, Section lli and Summer 1975 Addenda design provisions for Class 2 components stated in paragraphs NC 7153 for the installed manual block valve configuration. GPC stated the relief would allow Vogtle Electric Generating Plant (VEGP) to retain the manual block valves that are located in series with overpressure protection devices discharging to the recycle hold up tanks and the reactor coolant system. These manual block valves were installed as part of the original Westinghouse standard design.
The staff has reviewed GPC's request for the alternative pursuant to 10 CFR 50.55a(a)(3).
The staff finds that ASME Code, Section lll requirements for Quality Group B components (ASME Code Class,2 components) as stated in 10 CFR 50.55ald), apply to nuclear power plants whose applicctions for construction permits (cps) were docketed after May 14, 1984. The cps for Vogtle Units 1 and 2 were docketed before May 14,1984. Therefore, the regulations in 10 CFR 50.55a(d) concerning ASME Code, Section til design requirements do not apply to Vogtle Units 1 and 2. Accordingly, authorization of an altemative to ASME Code, Section ill design requirements pursuant to 10 CFR 50.55a(a)(3) is unnecessary and inappropriate for these nuclear plants, in its Final Safety Analysis Reports (FSARs), GPC committed to design and construct both Vogtle units in accordance with ASME Code, Section ill design provisions, in its July 11, 1996, letter, GPC identified a number of ASME Code Class 2 block valves installed in the Vogtle plants that did not meet the design requirements of ASME Code, Section lil,

paragraphs NC 7153. The NRC staff views the licensee's discovered condition of non-I (()
compliance with the ASME Code, Section lli design provisions as a deviation from plant licensing commitments. Accordingly, the licensee may either modify the plant to conform to the provisions of the current licensing and design basis information, or change the

current licensing and design basis information to accurately reflect the existing plant design. Action may be taken pursuant to the provisions of 10 CFR 50.59. Depending on the results of the licensee's evaluation, a license amendment may be required.
