OFFICE OF INVESTIGATIONS REPORT NO. 2-97-005. AND NOTICE OF

VIOLATION

Dear Mr. Morey:

On November 29. 1997 the U.S. Nuclear Pegulatory Commission (NRC) completed an

inspection at your Farley Nuclear Plant sFNP).

The enclosed report presents

the results of that inspection.

During the 6-week period your conduct of activicies at FNP was generally

characterized by safety-conscious operations, sound engineering and

maintenance practices, and careful radiological work controls.

However,

violations of NRC requirements were identified.

A violation was identified associated with plant operation outside of the

design basis due to a degraded flooding t arrier (i.e. . cork seal) in the main

steam valve room.

The NRC commends the performance of the senior reactor

operator who ultimately caused this issue to be appropriately characterized:

however, we were particularly concerned about the longstanding nature of this

problem and the multiple opportunities to have properly characterized it

sooner. Additionally, we are concerned regarding the lack of appropriate

engineering review of deficiency reports which may have identified the design

basis issue sooner.

Consequently, this violation was considered for escalated

enforcement due to previous inadequate corrective actions and recent similar

issues associated with the penetration room boundary, but was not pursued as

such because of the low safety significance involved.

The second violation was associated with the closecut of an Unresolved ltem

involving the lack of tornado missile protection for the Turbine Driven

Auxiliary Feedwater (TDAFW) pump vent stack. We have determined that the

failure to provide tornado missile nrotection for the TDAFW Pump vent stack is

a violation of NRC requirements.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your-

response, you should document the specific actions taken and any additional

-act'ons you plan to prevent recurrence of the violations. After reviewing

your response to this Notice, including your proposed corrective actions and

the results of future inspections. the NRC will determine whether further NRC

enforcement action is necessary to ensure compliance with NRC regulatory

requirements.

This report also identifies a non-cited violation (NCV) related to the failure

to maintain certain emergency planning inventory checklist documentation

complete and accurate.

As identified by your staff and subsequently

determined by the NRC Office of Investigations (01) an Emergency Preparedness

Technician failed to conduct certain required equipment inventories and

deliberatly falsified the checklists.

The synopsis of the 01 investigation is

attached to the enclosed report.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of

this-letter and its enclosures will be placed in the NRC Public Document Room.
