UPDATE TO STAFF RESPONSE TO TASKING MEMORANDUM I AND STAKEHOLDER CONCERNS Attached for your information is the staff's third update to the plan of short- and long-term actions to respond to selected issues raised during the July 30,1998, hearing before the l Senate Subcommittee on Clean Air and Wetlands, Private Property, and Nuclear Safety and '

the July 17,1998, Commission meeting with stakeholders.

Additions and changes to the October 30,1998, update are marked in redline and strike out.

l Explanations for changes are provided in the associated remarks.

i There continues to be considerable progress toward the completion of program milestones and l initiatives as evidenced by: the approval of the license transfer rule by the Commission, the I development and transmittal of a revision to the Enforcement Policy associated with non-risk l significant violations, the issuance of a paper to the Commission clarifying the staff's interpretation and applicability of the backfit rule to decommissioning, the issuance of interim guidance on the implementation of Risk-Informed Regulation, and improved guidance for the issuance of Confirmatory Action Letters.

Initiatives with the Commission for review and approvalinclude: the revision to the Enforcement Policy, the applicability of the backfit rule to decommissioning activities, and the staff's plan for addressing the standardization of decommissioning licensing actions and milestones for rulemaking. Initiatives scheduled to be submitted to the Commission prior to the next update include: revised source term rulemaking, methods to eliminate dual regulation at in situ leach facilities, and a paper on legislative and rulemaking options to enhance the Commission's ability to use informal adjudicatory procedures.

Chairman Jackson Commission meetings have been scheduled to discuss selected tasking memorandum items, currently including topics such as the improvements in Risk-Informed Regulation on January 11,1999, and Reactor Ucensing on January 13,1999. The next update of the staff response will be providsd to the Commission during the first week of January 1999.
