Dear Chairwoman Jackson:

As the Congressman who represents the Paducah Gaseous Diffusion Plant in Paducah, Kentucky, I am writing to request your assistance in addressing the tennination in shipments of diffuse low concentrations of special nuclear material (SNM) from this plant to Envirocare's

- waste disposal site in Utah.

While I do not advocate any action which would undermine health or safety, it is my understanding that NRC's own analysis of the SNM from the Paducah facility indicates this

-waste poses no threat of a criticality incident because it is dispersed throughout tons of dirt and other debris.

Current rti.es limiting the possession of ities of SNM to 350 grams should be reexamined in this case due to the fact that the DM concentration in waste materials from the Paducah facility poses no threat to health or safety. It would be my hope that you would agree to meet with all interested parties to formulate an interim rule allowing an exemption from the 350 gram limit for mixed wastes with low SNM concentration requiring treatment prior to permanent disposal. Such an exemption would help insure the contir'tation of Paducah's waste shipments to the Envirocare site in Utah.
