MOTION TO STR:KE Louisiana Energy Services, L.P. (" Applicant") moves to strike the attachment to " Citizens Against Nuclear Trash's Reply Proposed Supplemental Findings Of Fact And Conclusions Of Law Regarding Contentions B And J.3" filed on October 14. In Paragraph 18 of that document, the Intervenor refers to Applicant's statement that the use of" maximum concentrations of radionuclides" is a conservatism, referencing page A-9 of the FEIS. That reference is in error. The proper reference should be FEIS page A-8. In footnote 2 ofIntervenor's above referenced document,Intervenor states that had it been given adequate notice that this item was considered a conservatism, it would have introduced evidence in the form of the attachment. The FEIS statement speaks for itself and has 1
been available to the public, including Intervenor, since August 1994. Therefore, it is totally inappropriate for this attachment now to be submitted to the Board and Applicant requests thai the attachment be disregarded by the Board in its consideration of the remanded issues LOUISIANA ENERGY SERVICES, L.P.
