SUBJECT: NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY

(INSPECTION REPORT NOS. 50-321/86-06 AND 50-366/86-06)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted

February 24-28 and March 18-19, 1986, at the Edwin I.

Hatch Plant, Baxley,

Georgia.

This inspection included a review of the security system computer

failures and compensatory actions taken during the months of January and February

1986. As a result of this inspection, a significant failure to comply with NRC

regulatory requirements was identified, and accordingly, the NRC's concerns

relative to the inspection findings were discussed by Dr. J. N. Grace, Regional

Administrator, of this office and Mr. J. P. O'Reilly, Senior Vice President,

Nuclear Operations, of your office in an Enforcement Conference held in the

Region II Office on March 14, 1986. A Confirmation of Action Letter was also

sent to you on March 5, 1986.

The first violation described in the enclosed Notice of Violation and Proposed

Imposition of Civil Penalty involved a failure to implement approved compensatory

measures following the loss of alarm annunciation capability in both the central

and secondary alarm stations following thirteen security system computer failures

during the months of January and February 1986. The events that resulted in this

violation included inadequacies in procedures, compensatory measures, management

control, and reporting. Although the review included only the months of January

and February, the inspection showed that this type of computer failure was a

relatively common occurrence since the installation of the computer system in

late 1984. Several other violations are also described in the enclosed Notice of

Violation.

To emphasize the need to implement adequate procedures and compensatory measures,

to maintain adequate management control and review, and to report security events

to the NRC in a timely fashion, I have been authorized, after consultation with

the Director, Office of Inspection and Enforcement, to issue the enclosed Notice

of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty

Thousand Dollars ($50,000) for the violation described in the enclosed Notice.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1985), violation I described in

the enclosed Notice has been categorized as a Severity Level III violation, and

violations II.A through II.E have been categorized as Severity Level IV

violation is $50,000.

The escalation and mitigation factors in the Enforcement

Policy were considered, and no adjustment of the base civil penalty has been

deemed appropriate.

In this case, the base civil penalty could have been

increased by 50 percent because of the number and duration of the violations but

was left at the base value due to your prompt and comprehensive corrective

actions.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your response,

you should document the specific actions taken and any additional actions you

plan to prevent recurrence.

Af ter reviewing your response to this Notice,

including your proposed corrective actions, the NRC will determine whether

further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure; therefore, the enclosures

to this letter, with the exception of the report cover page which presents a

nonexempt summary, will not be placed in NRC's Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to

the clearance procedures of the Office of Management and Budget as required by

the Paperwork Reduction Act of 1980, PL 96-511.
