Dear Sir:
1 Enclosed herewith, as Attachments 1 and 2, respectively, are copies of the executed exclusion agreements with the Exeter and Hampton Electric Company and the Boston and Maine Railroad.
l Also enclosed, as Attachment 3, in FSAR Section 2.1.2.1 and Figure 2.1-4A, marked-up to reflect a change in the location of the power transmission line owned by the Exeter and Hampton Electric Company. The line is routed overhead outside of the protected area north of the site.
f This change will be incorporated in a future amendment to the FSAR.
We trust this information is acceptable and request the status of Confirmatory Issue No. I be reflected in the next Seabrook SER supplement.

, 1986 by and between PUBLIC SERVICE COMPANY OF NEW HAMPSHIRE, THE UNITED ILLUMINATING COMPANY, CENTRAL MAINE POWER COMPANY, FITCHBURG GAS & ELECTRIC LIGHT COMPANY, MONTAUP ELECTRIC COMPANY, NEW ENGLAND POWER COMPANY, CENTRAL VERMONT PUBLIC SERVICE CORPORATION, CANAL ELECTRIC COMPANY. THE CONNECTICUT LIGHT AND POWER COMPANY, NEW HAMPSHIRE ELECTRIC COOPERATIVE, INC., TOWN OF HUDSON, MASSACHUSETTS, LIGHT AND POWER DEPARTMENT, VERMONT ELECTRIC GENERATION AND TRANSMISSION COOPERATIVE, INC., MASSACHUSETTS MUNICIPAL WHOLESALE ELECTRIC COMPANY, MAINE PUBLIC SERVICE COMPANY, BANG 0R HYDRO-ELECTRIC COMPANY, l
TAUNTON MUNICIPAL LIGHTING PLANT COMMISSION (hereinafter collectively called the Joint Owners), all acting by and through NEW HAMPSHIRE YANKEE DIVISION OF PUBLIC SERVICE COMPANY OF NEW HAMPSHIRE, as agent (hereinafter NH Yankee) and EXETER & HAMPTON ELECTRIC COMPANY (hereinafter Exeter &
Hampton).
WITNESSETH THAT:
WHEREAS, NH Yankee is employed by the Joint Owners as their agent for the construction, licensin and operation of the Seabrook Nuclear Station (hereinafter the Station ; and WHEREAS, Exeter & Hampton owns certain electric lines and other facilities together with rights of way in Seabrook and Hampton Falls, New Hampshire used in the operation of its electric utility operations (hereinafter its facilities), which facilities cross a portion of the Station site; and WHEREAS, the regulations of the Nuclear Regulatory Commission require the holder of an operating license for a nuclear facility to have the power to exclude all parties from the Station site in the event of a nuclear incident; and WHEREAS, the parties agree that in such cases NH Yankee should have the authority to exclude all parties, including Exeter & Hampton, from the site, inc.luding from the facilities of Exeter & Hampton.
NOW THEREFORE, in consideration of the mutual covenants and agreements contained herein, NH Yankee and Exeter & Hampton for themselves, and their principals, and their successors and assigns, hereby agree as follows:
1.
Where used herein, the following words and phrases shall have the definitions indicated in this paragraph:
a.
" Joint Owners" means the electric utilities identified above as Joint Owners and suci other electric utilities as may become participants under the Agreement for Joint Ownership, Construction and Operation of New Hampshire Nuclear Units dated May 1,1973, as amended, covering the

(" Participation Agreement"),
b.
"NH Yankee" means the New Hampshire Yankee Division of Public Service Company of New Hampshire, and after the transfer date, and after Exeter & Hampton receives written notice that regulatory approval of a transfer to the new entity has been obtained, shall mean New Hampshire Yankee Electric Corporation, or its successors or assigns in the management or operation of the Seabrook Station.
2.
Exeter & Hampton hereby grants to NH Yankee, and its successors and assigns, authority to exercise control over and exclude from that portion of its facilities located within the exclusion area of the Station, shown on Exhibit C recorded in the Rockingham County Registry of Deeds, Plan No. D-4494, any and all persons including officials and agents of Exeter & Hampton, in the event of an incident or occurrence at the Station, for which the rules or regulations of the Nuclear Regulatory Commission, or its successor, require the operator of the Station to exercise such control and exclude persons or activites from the exclusion area.
3.
NH Yankee agrees that in the event it is required to exercise the authority granted to it herein it will do so in accordance with the provisions of the Emergency Plan for Seabrook Station or amendments or replacements thereof having the same general purpose and such other orders as may be issued by the authorities overseeing the situation; and further agrees that it will terminate the exclusion of Exeter & Hampton as soon as permitted to do so by the authorities or the circumstances.
4.
NH Yankee further agrees that in the event it is required to exercise the authority granted to it herein it will as soon as practicable notify Exeter & Hampton by contacting by telephone the party designated by Exeter & Hampton to receive such notice, and that when it is permitted to terminate the exclusion it will notify Exeter & Hampton as soon as practicable.
5.
The Joint Owners represent and warrant that they have duly authorized NH Yankee to act as the agent of each of the utility companies which constitute the Joint Owners in the administration of this Agreement and the implementation of the Joint Owners' rights hereunder.
Exeter & Hampton shall be entitled to rely upon the decisions and actions of NH Yankee as the binding acts of the Joint Owners.

WITNESSETH THAT:
WHEREAS, NH Yankee is employed by the Joint Owners as their agent for the c nstruction, licensing and operation of the Seabrook Nuclear Station, (hereinafter tha Station); and WHEREAS, Boston & Maine owns a certain right of way in Seabrook and Hampton Falls, New Hampshire used in the operation of the Boston & Maine Railroad which right of way ccvers a portion of the Station site; and WHEREAS, the regulations of the Nuclear Regulatory Commission reaufre the holder of an operating license for a nuclear facility to have the power to exclude all parties from the Station site in the event of a nuclear incident; and WHEREAS, NH Yankee and Boston & Maine agree that in such cases NH Yankee should h ve the authority to exclude all parties f rom the site including its right of way creasing through the site.

.NOW THEREFORE, in consideration of the mutual covenants and promises contained h; rein, NH Yankee and Boston & Maine for themselves, their principals, successors and ccsigns hereby agree as follows:

28.84, any and all persons including officials and agents of Boston & Maine, in the event of an incident or occurrence at the Station which the regulations of the Nuclear Regulatory Commission require the operator of the Station to exercise such control and exclude all parties from the exclusion area.
2.
NH Yankee agrees that in the event it is required to exercise the authority granted to it herein it will do so in accordance with the provisions of the Emergency Plan for Seabrook Station and such other orders as may be issued by the authorities overseeing the situation.
3.
NH Yankee further agrees that in the event it is required to exercise the authority granted to it herein it will as soon as practicable notify Moston & Maine by contacting by telephone the party designated by Bo ston & Maine to receive such notice.

The Joint owners severally and not jointly in proportion to their ownership of the Station hereby agree to indemnify and save harnless Boston & Maine, its su b-sidiaries and their successors or assigns, and their officers, agents and servants against any and all loss, cost, damage or expense and against any and all clains or suits for damage to property, personal injury or death, arising out of or in any way referable to the exercise of the authority granted herein to their agent, NH Yankee or any of its employees, of ficers or servants under the terms of this Agreement whether such loss or damage is suffered by any party to this Agreement or by others.

ATTACHMENT 3 SBN-1079 SB 1 & 2 FSAR Wiv) 2.1.2 Exclusion Area Authority and Control 2.1.2.1 Authority As shown in Figure 2.1-4A, the exclusion area for the Seabrook site is the site beundary. The area within the site boundary will provide a minimum distance from either containment building to the site boundary of 3000 feet.
The exclusion boundary presently includes, in addition to lands owned by the Public-Service Company of New Hampshire, the followings A section of railroad track, owned by the Boston and Maine Railroad, a.
b.
A seetion of power transmission line owned by the Exeter and Hampton Electric Company.
c.
Portions of the Brown's River and Hunt's Island Creek.
The Boston and Maine Railroad line, which approaches within about 1800 feet to the nearest reac tor containment, is not used for passenger service, and is used only infrequently for freight service. The line is currently terminated to the south by an inoperable bridge between Newburyport, Massachusetts, and Salisbury, Massachusetts. Provisions have been made with the Boston and Maine Railroad to control traffic on the railroad right of way passing through the site in case of an emergency.

The control of traffic in case of an emergency on those portions of the Brown's River and Hunt's Island Creek that fall within the exclusion area comes under the authority of the director of New Hampshire State Civil Defense Agency. Provisions for notification and removal of individuals from this area are described in the station's emergency plans in Section 13.3.
2.1.2.2 Control of Activities Unrelated to Plant Operation Other than transit through the exclusion area by the Boston and Maine Railroad, and infrequent boot tra f fic along the Brown's River and Hunt's Island Creek, along with the access to Brown's River provided by Rocks Road the only activity on the site which is not directly related to plant operation is the public information center located about 1200 feet southwest of the plant.
The information center will be open specific hours, and will provide a focal point for the general public to become familiar with nuclear power and the Scabrook Station.
It is not expected that more than a few hundred people would normally be present at the information center at any one time.
