SUBJECT: NRC INSPECTION REPORT 50-382/97-27, NOTICE OF VIOLATION, AND
EXERCISE OF ENFORCEMENT DISCRETION
Dear Mr. Dugger:
An NRC inspection was conducted November 17 through December 5,1997, at your Waterford
Steam Electric Station, Unit 3, reactor facility. The enclosed report presents the scope and
results of that inspectior).
During the inspection, two violations of NRC requirements were identified.
. The first violation involved the failure to properly implement design control measures for the
refueling water storage pool level indication, a condition that existed since initial plant startup.
We have reviewed the circumstances that resulted in the identification of the design problem
and the correct;ve actions you have implemented. As a result, we have determined that this
violation meets the criteria for the exercise of enforcement discretion, as described in
Section Vli.B.3 of the NRC Enforcement Policy, which addresses the identification of old design
issues. After consulting with the Director, Office of Enforcement, this violation is not t;eing cited.
The reasons for i,0t citing this 'fiolation are that your staff identified the design deficiency, as a
result of an astute observation by an instrumentation and control technician; the condition was
not likely to have been identitled through normal surveillance activities; and appropriate
long-term corrective actions were implemented.
The second violation involvec the failure to promptly initiate a condition report when an adverse
condition affecting a safety-re'aied system was identified. While your staff should be
commended for identifying this issue, a condition report was not initiated ur12 weeks after the
identification of the refueling water storage poolinstrumentation deficiency. An opertoility
determination was not made L ntil after the condition report was initiated. To emphasize the
importance of timely operability decisions, the violation is cited in the enclosed Notice of
Violation (Notice), The circumstances surrounding the violation are described in detail in the
enclosed report.
