Dear Dr. Richards:

I am responding to your September 22,1998, letter in which you requested exernption from the annual fee requirement of 10 CFR Part 171.15 for the U.S. Department of the Air Force's research reactor, License No. R-130, at McClellan Nuclear Radiation Center (MNRC). The basis for the exemption is that the MNRC reactor meets the criteria for exemption in 10 CFR 171.11(a)(2). E-ajosed please find a copy of my September 9,1998, letter to you granting the exemption ,ron the FY 1998 annual fee for the MNRC.

! You are aware that you must certify annually that you meet the exemption criteria specified in 10

( CFR 171.11(a)(2); August 1999, would be the time frame to request an exemption from the FY

! 1999 annual fee.

i I am responding to your August 20,1098, letter in which you requested exemption from the l

FY 1998 annual fee requirement of 10 CFR Part 171.15 for the U.S. Department of the Air Force's research reactor, Ucenst No. R 130, at McClellan Nu: lear Radiation Center (Mb'RC).

The basis for the exemption is that the MNRC reactor meets the criteria for exemption in 10 CFR 171.11(a)(2).

The final rule which became effective August 10,1998, grants exemption from the FY 1998 annual fee for Federally-owned research reactors operating at a thennal power level of 10 megawatts or less. You must certify annually that you meet the exemption criteria spscified l in 10 CFR 171.11(a)(2).
