McClellan AFB, CA 95652-2504 Dear Dr. Richards-l am responding to your August 20,1998, letter in which you requested exemption from the FY 1998 annual fee requirement of 10 CFR Part 171.15 for the U.S. Department of the Air Force's research reactor, License No. R-130, at McClellan Nuclear Radiation Center (MNRC).

10 CFR 171.11(a)(2).

The final rule which becarne effective August 10,1998, grants exemption from the FY 1998 annual fee for Federally-owned research reactors operating at a thermal power level of 10 megawatts or less. You must certify annually that you meet the exemption criteria specified in 10 CFR 171.11(a)(2).
