ACCEPTANCE OF COMPLETION REPORT FOR RlFLE, COLORADO, VICINITY PROPERTY RF-479

Dear Mr. Rael:

By letter dated November 25,1998, the U.S. Department of Energy (DOE) provided the Rifle, Colorado, Vicinity Property RF-479 Completion Report (VP CR) to the U.S. Nuclear Regulatory Commission (NRC) for review. The NRC staff's review of the VP CR is enclosed.

Concurrence by the NRC on this VP CR is required because special circumstances resulted in i Supplemental Standards being invoked during remedial action. The NRC staff concludes that the information provided by DOE in the RF-479 CR provides reasonable assurance that supplemental standards for soil cleanup have been properly applied. Therefore, the NRC staff concurs that the use of Supplemental Standards and the remediation of the vicinity property l were completed in accordance with U.S. Environmental Protection Agency standards. The U.S. Nuclear Regulatory Commission (NRC) staff reviewed the 1998 version of the Vicinity i Property Completion Report (VP CR) for the Rifle Vicinity Property (VP) RF-479, MK-Ferguson Company, dated February 19,1998. 1 The VP CR describes the remedial actions (radiological cleanup) and verification activities j performed at VP RF-479. This site is U.S. Highway 6 & 24, Right-of-way, north of the Old Rifle  ;

site Mill Site, Rifle, CO. l Per agreement, supplemental standards have been applied to residual radioactive material left in place along the highway right-of-way road bed , and the steep and vertical slopes in the highway right-of-way both north and south side of the highway. Remediation was performed 1 according to the remedial action plan (RAP). These conditions, including the application of supplemental standards, were pre-approved by the State of Colorado Department of Transportation, the DOE, and the NRC via their concurrence with the RAP for the Rifle Site.

Appendix A, Radiological Survey Data for the Supplemental Standard, and Appendix B,  ;

Supplemental Standards Recommendation, serve as documentation of the application of '

supplemental standards of the remaining areas of contamination and their current radiological  ;

conditions. '

l Because the reason for the NRC's review of this VP CR is that the supplemental standards  ;

were used at the VP, the NRC staff review has been limited to areas where supplemental  !

standards were applied.

1 The radiological conditions within the Supplemental Standards areas are summarized as follows:

a. Exposure rate range at a level of one foot over contaminated areas - 8 to 215 R/hr
b. Average exposure rate over the supplemental standard area (s) - 18 pR/hr, including background, post reconstruction.
c. Range of Ra-226 concentrations in Supplemental Standards areas - <0 to 1055.5 pCi/g Background for the Rifle locale is an exposure rate of 13 uR/hr and 1.6 pCi/g of Ra-226. The data presented include bnckground.

  • The Vicinity property (VP) completion report (CR) provides a complete health risk analysis of the long term exposure of 100 mrem per year, and short-term unusual exposure of 500 mrem per year. The analysis demonstrated that a person would have to be in direct contact with the source for a lengthy period to receive exposures at those levels.

i The VP-CR also provides a cost analysis for the remediation , which indicates that the benefit to be received for full removal of the low level contaminated material is prohibitive. Therefore, application of U.S. Environmental Protection Agency (EPA) criteria 40 CFR 192.21 (a) and 192.21 (c) is appropriate.

NRC Staff Conclusion The NRC staff concludes that the information provided by the DOE in the VP CR for Rifle Vicinity Property RF-479 and other documents provides reasonable assurance that remediation of this VP and the use of supplemental standards were completed in accordance with EPA standards.
