Dear Mr. Jensen:
This letter is to inform you that Certificate of Compliance No. 5362, for the Model No. Natick Irradiator package is terminated. Accordingly, the use of this package under the General Licenses of Subpart C of 10 CFR Part 71 or under the provisions of 49 CFR 6173.471 is terminated.
By letter dated September 30, 1997, you requested that NRC Quality Arsurance (QA) Program Approval No. 0238, issued to the U.S. Department of Agriculture (USDA) under 10 CFR Part 71, be terminated.
Ir. a telephone call on September 30, 1997, we informed Mr. Jack Patterson cf your staff that termination of your QA program approval would result in termination of Certificate of Compliance No. 5362. As a result, the Natick Irradiator would no longer be authorized for transport of radioactive material under the provisions of 10 CFR 671.12 cr 49 CFR 6173.471. Mr. Patterson confirmed your request that the QA program approval be terminated. NRC Quality Assurance Program Approval No.
0238 was terminated on September 30, 1997.
In your letters dated April 24 and August 29, 1997, to Dr. Keith D. Brown, NRC Region I, you stated that the USDA will transport the radioactive sources contained in the Natick irradiator by transferring the sources to a certified shipping container using a licensed company with a QA program approved by the NRC under Part 71. You identified the Model No. 1500 package (NRC Certificate of Compliance No. 5939) as a package that could be used to transport sources used in the Natick Irradiator. Note that any party taking possession of the radioactive material at an irradiator facility for the purposes of unloading the sources from the irradiator and transporting the sources, must have an NRC or state license that authorizes possession at that facility.
