Dear Ms. Johnson:

On November 25,1997, we issued Amendment No. 93 to the licenses for Byron, Units 1 and 2, approving the, Installation and use of the C&D Charter Power Systems, Inc. (C&D) batteries.

Based on the August 7,1997, Commonwealth Edison Company (Comed) submiital, our Safety Evaluation stated that "the C&D batteries were sized using an aging factor of 1.25 ar.d a design margin of 10 percent.". Subsequently, it was brought to our attention that in an October 24,;

1997, letter Comed stated that as a result of testing of C&D battery cells at the factory, the design margin now used to size the batteries is 5 percent.

As a result of our review of the October 24,~ 1997, letter and discussions with the Comed staff on December 2,1997, we have concluded that a design margin of 5 pen:ent for the C&D batteries at Byron Station is acceptable. This conclusion is based on the fact that the factory

and that the expected load growth on the batteries is small and is tracked and approved by 1

Based on the August 7,1997, Commonwealth Edison Company (Comed) submittui, our Safety Evaluation stated that "the C&D batteries were sized using an aging factor of 1.25 and a design margin of 10 percent." Subsequently, it was brought to our attention that in an October 24, 1997, letter Comed stated that as a result of testing of C&D battery cells at the factory, the design margin now used to site the batteries is 5 percent.

This conclusion is based on the fact that the factory testing at the one-minute rate supports a design margin of between 5 percent and 10 percent 4

and that the expected load growth on the batteries is small and is tracked and approved by calculation by Comed before any additions can be implemented.
