Gentleman:

On April 16, 1986 Counsel for the Citizens Association for Sound Energy (CASE) wrote to Guy Cunningham, Executive Legal Director of the Nuclear Regulatory Commission (NRC) regarding the failure of the Staff to promptly notify the Board of issues which are relevant to the issues in this proceeding.

We had hoped our letter would have produced the Board notifications.

Unfortunately CASE has not received even the courtesy of a reply to our letter to the Staff, and the Board has not been notified of issues and events which are relevant to the ongoing litigation in this case.

As a result we are sending the Board a copy of the letter to the staff which identifies our concerns, and two of the documents which we believe the Board should havo in its possession.

We have not included the transcripts of issues raised by new allegers because we understand that the information will ultimately be produced by the staff in the form of either an inspection report or another SSER.

In the event that these allegations are not reported on the public record or the record in this proceeding CASE will take the proper action to include the information in the record since the allegations are relevant to Contention Five.
