McGuire Nuclear Station Docket Nos. 50-369 and 50-370 Technical Specification Amendment for Containment Penetrations

Dear Mr. Denton:

Attached are proposed license amendments for McGuire Nuclear Station, Facility Operating Licenses NPF-9 (Unit 1) and NPF-17 (Unit 2).

The proposed amendments seek to move the tables listing secondary containment bypass leakage paths and containment isolation valves from the Technical Specifications into the bases and to change the tables and to add three penetrations and update the tables for other planned modifications. The removal of tabular listings from the Technical Specifications is an area of improvement of Technical Specifications that has been identified by the Atomic Industrial Forum (AIF) and the NRC.

This proposal presents a unique opportunity to demonstrate how Technical Specifications can be simplified relatively easily. Accordingly, we would interpret timely staff review and approval as a positive sign that the NRC is ready and willing to improve Technical Specifications. Duke considers that approval of the change is not essential prior to restart of Unit 1 following the current refueling outage inasmuch Duke is required to meet 10CFR 50, Appendix J and has committed to perform Type B tests on the new service penetrations. Alternately, the staff may consider that such approval is required prior to restart. Duke will support the staff in whatever actions are necessary to support restart of the unit.

Attachment I contains the proposed changes to the Technical Specifications and the bases, Attachment 2 contains the justification for the change, and provides an analysis conforming to the standards contained in 10CFR 50.92 as required by 10CFR 50.91 which concludes that the proposed amendments do not involve a significant hazards consideration. Attschment 4 contains the nuclear station modification safety evaluation for this modification as an example of how such reviews are done to assure that modifications do not negatively impact plant safety.
