FITNESS FOR DUTY Dear Mr. Warden-The Nuclear Regulatory Commission (NRC) has received a letter dated September 22, 1997, from South Carolina Electric and Gas Company's (SCE&G)

V. C. Summer Nuclear Station, advising of your confirmed positive test for alcohol on August 25, 1997 while you were assigned to an offsite training

)osition.

In the September 22, 1997 letter, SCE&G requested that your license

)e com1.1tioned to restrict you from performing licensed duties until a medical release from an alcohol treatment program is obtained.

A copy of the September 22. 1997 letter (including only the attachment pertaining to your case) is enclosed.

We want to make clear to you the consequences of your actions as related to the requirements governing the fitness for duty for a licensed operator. The purpose of the NRC's Fitness for Duty requirements is to provide reasonable assurance that nuclear power plant personnel work in an environment that is free of drugs and alcohol and the effects of the use of these substances. The abuse of alcohol is a serious matter which undermines the special crust and confidence placed in you as a licensed operator. The NRC considers an operator's fitness for duty to be crucial to the protection of the public health and safety because of the vital role licensed operators have in the safe operation of nuclear power facilities. Therefore, you are reminded that your individual license is subject to all of the provisions of 10 CFR Part 55.

Specifically, Section 55.61, "Hudification and Revocation of Licenses,"

states, in part, that ".... Any license may be revoked, suspended, or modified, in whole or in part... for a determination of unfitness for scheduled work as a result of the consumption of alcoholic beverages."

On October 15, 1997, the NRC issued a license amendment restricting you from performing licensed duties until the NRC is notified by SCE&G and agrees that your medical status is acceptable.

Prior to removal of this license resriction, you are also required to submit a writ +.an response to the NRC addressing the actions you have taken to ensure your ability and willingness to carry out the special trust and confidence placed in you as a licensed operator and to abide by all fitness for duty and other license requirements and conditions.

Based upon the actions already taken by SCE&G, the NRC has decided to take io additional action with renect to your license at this time beyond the issuance of this letter.

Also, you should be aware that your employer's Fitness for Duty Policy incorporates the requirements of 10 C"R Part 26, " fitness for Duty Programs.* A similar problen in the future may substantially affect your authorization for unescorted acce>s to a protected area of a licensed facility.

We plan to place this letter and the September 22, 1997 letter from SCE&G in your 10 CFR Part 55 docket file.

If you believe any information on this matter (this letter or the referenced letter from SCE&G) is inaccurate or if you wish to add information that you believe important to our full understanding of this matter, please provide it in writing to me within 30 days of receipt of this letter.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2.

Title 10 Code of federal Regulations, records or documents compiled for enforcement purposes are placed in the NRC Public Document Room (PDR). A copy of this letter without its enclosure and with your address removed, and any response, will be placed in the PDR 45 days after the date of this letter (unless you provide sufficient basic to withdraw this letter or withhold this information). At that time, a copy also will be provided to SCE&G.
