Dear Mr. Miller:

1This letter refers to your November 19,1997, letter entitled " Response to inspection Repcrt (IR) -

70-7002/97006 Notice of Violation (NOV)" which was transmitted to you by our letter dated October 20,1997, with inspection Report 70-7002/97006.- In your response, you acknowlooged the two cited violations 70-7002/97006-01 and 70-7002/97006-02, but you. disagreed with -

y~ example B.7 of 97006-02 concoming the submission of reports regarding unatunded security - ~ ~

containers found unsecured. We have re, 'ed your corrective actions for the violations and

. have no further questions at this time. .Your w.rective actions will be examined during future inspections We also understand that you have made changes to your security plans pursuant to 10 CFR 76.68. The changes made to the security p'ans will also be reviewed during future inspections.

- We have reviewed your response and bacis for disagreement with example B.7 of violation -

97006-02.4 After careful consideration of the information provided by you, we concur with your.

" ascessment and withdraw example B.7 of violation 97006-02. We confirmed receipt of Security Event Report 97-14 dated September 11,1997, which reported the August 16,1997, security event regarding open and unattended security containers. We further concur that the May 6, '

? 1997, " lock box" security event did not need to be reported because your investigation concluded that during the time the " lock box" was open the store custodian was in the area and -
