NRC INSPECTION REPORT 70 7002/97006(DFS) AND NOTICE OF VIOLATION

Dear Mr. Miller:

This letter refers to the inspection conducted on September 2 5,1997, at the Portsmouth Gaseous Diffusion Plant. The inspection included a review of the approved Portsmouth's Security Plan for the Protection of Classified Matter and Physical Security Plan. At the conclusion of this inspection, the findings were discussed with members of your staff during a final telephonic exit on September 9,1997, The enclosed report presents the results of this inspection.

Areas examined during the inspection are identified in the report. Within these areas, the inspection consisted of interviews with personnel, observations of activities in progress, walk-throughs with your staff, and selected examination of procedures and associated records.

Based on the results of this inspection, the NRC has determined that two violations of NRC requirements occurred. These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding them are described in detail in the subject inspection report.

These violations are of concem because they are similar to the violations you were cited for as a result of the May 5-9,1997, security inspection of the Paducah Gaseous Diffusion Plant.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. For your consideration and convenience, an excerpt from NRC Information Notice 96-28, " SUGGESTED GUIDANCE RELATING TO DEVELOPMENT AND IMPLEMENTATION OF CORRECTIVE ACTION,"is enclosed. The NRC will use your response, in part, to determine whether further enforctment action is necessary to ensure compliance with regulatory ,equirements, in accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosure (s), and your response will be placed in the NRC Public Document Room.
