4 We have comp (leted our acceptance review of the' preliminary final PamedialRAP) a Action Plan at Spook, Wyoming. The information received from DOE on December 13 has been found to be adequate to support initiation of our in depth review. The review of these documents now takes priority over any other NRC staff UMTRA activities.

O We are scheduled to provide DOE with a draft Technical Evaluation Repon, d

(TER), which will address our concurrence and any open issues, by the end of January,1989.

In addition to the RAP and Site Design documents, we received your letter dated December 12, regarding a formal detennination on the overburden materials at the Spook, Wyoming site. As requested, we will send a response to DOE to confirm our understanding of this issue.
