Consequently, as discussed in my conversation with Mr. Jeffries, we are voiding your application until such time as you are able to establish a permanent site. This action is without prejudice to resubmission and we will maintain the information you previously submitted on file for a short period of time.

From : La C&rter a Steve Eckberg An inspection on September 17, 1984 determined Southyest Nuclear exceeded, by threefold, their license limit of 5000 cubic. feet permitted for storage. An unannounced follow-up inspection was conducted by Iarry Carter and Steve Eckberg, Health Physicists for the Radiologic Health Branch, Department of Health Services, g
Sacramento at Southwest Nuclear facilities, 7066-A Commerce Circle, Pleasanton, California on September 26, 1984.
The' inspection was made to determine the progress Southwest Nuclear has made in removing the radioactive waste located in-

their storage facility and outside transportation vehicles. The inspection also included additional review of inventory. records, waste integrity inspection and r
discussions with U. S. Department of Transportation and U. S. Army representatives concerning the integrity and other shipping and storage violations associated with the Army's waste.
Jim Harvey, President and Thomas Dias, Alternate Radiation ~ Safety' Officer of
~
Southwest Nuclear were interviewed to determine the progress of waste removal.
[
They indicated approximately 2500 cubic', feet of the 15000 cubic feet on hand had been removed from the warehouse.
It could not be determined whether the waste i
had been delivered and accepted for disposal at U. S. Ecology's Richland, Washington low-level radioactive waste site. The inspectors noted an apparent, decrease in waste inventory within the warehouse.. Waste drums were still stacked.

March 26, 1984 (c) June 23, 1984 The walk around disclosed that waste in excess of 12000 cubic feet was on hand. Radioactive waste generated by the U. S. Army was not packaged in conformance with U. S. Department of Transportation Regulations (discussion with Jim Schuler, Inspector, U. S. Department of Transportation).
Casual observation of the drummed waste disclosed no obvious deterioration.
Discussions with Southwest Nuclear, U. S. Army and U. S. Department of Transporation personnel disclosed that remedial action on the nonconforming waste would be rapid and dialogue with Radiologic Health Branch, Department of Health Services will be ongoing until remedial action is completed.
Amendment to Southwest Nuclear's radioactive materldls license may be required.

Recommendations:
1.
Follow-up inspection by Radiologic Health Branch, Department of Health Services within 7 days.
2.
Future waste will need to have aisles between every two (2) pallets, to allcw for periodic inspection of drum integr ity.
3.
Amendment needed for new Radiation Safety Officer.
