Concurrence on Cushing-1 Stew Brown -
1 You have my concurrence on the issuance of license amendment no. 8 to K-M Cushing's license, based on the following:
(1) decisions made by John Hickey on 6/25/98 concerning the applicability of 10 CFR 20 Subpart H to Cushing Pit 4 activities (see 6/25/98 email from me to JHickey and RNelson); and (2) the scope of my review did not entail evaluating compliance with 10 CFR 51, including the assessment of environmental impacts for the RMSA effluent releases - it's my understanding that you and NRC's Office of General Counsel are responsible for that portion of the review; and j
(3) the approval of K-M's radiation safety plan is for Pit 4 activities with the understanding that NRC staff will inspect implementation of the plan during Pit 4 remediation activities and that a comprehensive review of the
' radiation safety plan will be conducted when K-M submits a d-plan for the entire site.

License Condition 11.L was added to reflect the licensee's commitment to maintal liquid effluent releases from both the RMSA and the retention pond to an annual cumu tive average less than 20 percent of the effluent limits stipulated in Appendix B of 10 CFR P 20.

License Condition 11.M was added to the license to authorize remediation of cid Sludge Pit 4, in accordance with the Acid Sludge Pit 4 Decommissioning Plan.
9.
License Condition 11.K was renumbered to 11.N, in order to accommodat three new license conditions.
All other conditions of the license shall remain the same. The revised Licens No. SNM-1999, which incorporates Amendment No. 8, the related Safety Evaluation, and Enviro ental Assessment are enclosed. Further, if you have any questions, please contact me at (301) 15-6605.
