SUBJECT:

MEETING WITH THE DEPARTHENT OF ENERGY AND ALL CHEMICAL IS0 TOPE ENRICHMENT, INC.

On October 21, 1986, the subject meeting was held in the 8th floor conference room of the Willste Building in Silver Spring, MD. A meeting agenda and list of attendees are attached.

The )urpose of the meeting was to discuss with All Chemical Isotope Enrichment, Inc.,

(ALCiemIE) and the Department of Energy (DOE) the likely rules and procedures which would apply to their unique situation. The facility which ALChemIE is considering would not utilize any radioactive materials. Therefore, Parts 30, 40 and 70 of Title 10, CFR, will not apply. However, Sections liv. and 101 of the Atomic Energy Act require that a license be obtained for a production facility

" determined...to be capable of the production of special nuclear material in such ouantity as to be of significance to the common defense and security."

ALChemIE intends to purchase and use centrifugal machines from DOE which are capable of enriching special nuclear material, but for an entirely different purpose. Therefore, the proposed use of the machines will require a license pursuant to 10 CFR Part 50.

Since no radioactive materials would be involved in the facility being considered by A1ChemIE, a large fraction of the requirements of 10 CFR Part 50 are not applicable. NRC fuel cycle staff will very soon identify the applicable portiens of the regulations which would apply.
