l approve publication of the proposed rule. However, I recommend that the staff perform an i
evaluation of comments received conceming backfit and consider the inclusion of an immediately effective backfit provision in the final rule. The rulemaking package'for the final rule i
should include the staffs assessment, justification, and conclusions conceming backfit.
1 I approve the staffs proposal to continue to refine the Standard Review Plan (SRP) for the proposed rule. During this process, the staff should continue to ensure that the SRP does not include prescriptive requirements and clearly acknowledges that licensees and applicants may provide attemative approaches to those presented in the SRP.
