IMPOSITION OF CIVIL PENALTY - $1,250 By EN 87-90 dated October 21, 1987 the Comission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Peralty in the amount of Two Thousand Five Hundred Dollars ($2,500) to the University of Virginia. This action was based on several violation involving: (1) failures to perform the surveys necessary to identify a high rcdiation area and to take appropriate action to properly post and control access to the area; and (2) failure to provide written procedures for the installation, operations, modification, and surveillance of experimental facilities.
The licensee responded to the Notice in a letter dated November 18, 1987. After careful consideration of the licensee's response, the staff has concluded that one violation should be withdrawn, the remaining violations occurred as stated, and that citigation of the civil penalty by 50 percent is warranted due to the licensee's extensive corrective actions. Accordingly, an Order Imposing a Civil Penalty in the amount of $1,250 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
