s Policy and Procedures on ASLB Protective Order 1 I. Overall Policy All employees and agents of the Department who are authorized to have access to-information which is protected by any orde'r-of an' Atomic Safety and Licensing Board should avoid and guard against causing, directly or indirectly, any disclosure of that information to any non-authorized person or persons. This policy extends to the information sought to be protected by protective orderc r9gardless of whether the Department has an independent third-party source for that information. Information cttained from such independent sources shall not be disclosed to any non-authorized persons if 1

that information is the same information which the protective order seeks to protect.

II. Definitions

"Protected information" as used in this statement of policy and procedures includes both (1) the definition of "protected information" as defined by any ASLB orders then in force, (2) identical incormation gathered from independent source's, and (3) all copies, notes, or other documents which contain that C'

information, regardless of source.

III. Physical Security Procedurqs

1. All protected information and material will at all times, except when in use, be kept in locked filing cabinets, as follows:

a. All original pleadings, transcripts, and l unredacted SPMC material (maroon pages) containing protected information will be kept in a locked cabinet in
b. All protected information pertaining to the Seabrook public notification system, including unredacted SPMC material (maroon pages), maps, information gathered by the Attorney General's office, and photographs will be kept in a locked cabinet in
c. All discovery documents which contain protected information will be kept in a locked filing cabinet in

Each Assistant Attorney General and paralegal who has copies of pleadings, pertshal notes, data or any other duplicates of papers or material containing protected information will keep such information in locked filing cabinets in M as lone, as he or she has need for such information; such material will be shredded when it is no longer needed.
2. There will b9 an orientation program for each ne attorney and staff person in the Nuclear Safety Unit to instruct that person regarding'the terms of the protective orders and the procedures to,be followed to ensure that protected information is not disclosed; all non-attorney staff in the Nuclear Safety Unit are re,,quir'ed to sign the affidavit agreeingtocomplywiththepqotechiveorder.

3. Any expert or consultant utilized by the Attorney General's Office or other staff of the Attorney General's Office to whom protected information is disclosed (as necessary,,for litigation purposes only) willgge. instructed as to the terms of the protective order and :he procedures to '

follow to ensure compliance with its provisions; all such experts and staff are required to sign the affidavit, prior to any disclosure, agreeing to comply with the protective order.

4. All attorneys are instructed to proofread all pleadings prior to service specifically for the purpose of verifying that protected information is not inadvertently disclosed. Whenever use of protected information is not essential, pleadings should not include such information. All pleadings that must contain protected information are to be served in accordance with the terms of the protective order.
