What is the matter that is being re' quested for investigation?

A former licensee employee telephonically contacted Region II, IAC, and informed T. A. Nash that she had been in contact with L. L. Robinson of 01, Region II Office, in September of 1985. She stated that she had shared all of her allegations concerning Carolina. Power and Light Company (CP&L) with the Office of Investigations and wanted to back-up that situation by calling Mr. Nash informing him about the allegations. T. A. Nash took <

all of alleger's concerns and during subseq'uent conversations and coordina- '

tion. settings with L. L. Robinson .found that Robinson apparently had not

received all of her concerns. This request is an effort to ensure all of ,

the. alleger's concerns involving w'r'ongdoing, falsification of documentation. l and harassment /intimidatio'n are properly' add,ressed. - - l

On July 1,1986, Steve M. FROST, Health Physics Technician (HP Tech),

Dosimetry Section..at Carolina Power and Light Company's (CP&L) Shearon Harris !!uclear Power Plant (SHNPp), was interviewed by NRC Investigator Larry L. R'binson o in the NRC Resident inspector's_0ffice at SHNPPJ FROST

FROST advised that he h'as been a CP&L.eaployee in'the Dosimetry .SeftTon at 1 SHNPP s'ince November 19, 1984.' He' stated tha.t Patty MIRIELLO was working. l

.f.or CP&L with him th dosimetry for about six months during earl-y 1985.

  • 2 FROST. advised that MIRIELLO exhibited a superior attitude to the rest of -

. the HP Techs when she first came into the section. He stated that MIRIELLO was always having personality conflicts with 'him and another. tech 3 . ,

,. Vera POE. FROST stated that, from his observat' ions of'MIRIELLO's attitude l

. and actions toward POE, who is a black female, MIRIELLO could possibly by - .

prejudice against blacks. He advised that MIRIELLO',s personoel file should ,

have a tecord of her_ incidents with POE. , ,

FROST stated that he personally got involved in an incident with.MIRIELLO on a Friday during March or April of 1985. He stated that MIRIELLO checked ith them in the whole

, them. FROST stated that the Dosimetry Section. Foreman, John O'HALLORAN, asked MIRIELLO to do something for him which evidently required.MIRIELLO to be aw'ay from the whole body count room for a period of time. FROST. stated that MIRIELLO lef t the sources unattended in the whole body count room. He

- advised booth, butthat Chris CRUMBAUGH that CRUMBAUGH had told him was in the room, (FROST) that he working (on the face-fitCRUM -

idea ,that thf' sources were there. -

FROST' stated that he brought the sources back into the Dosimetry Section -

office, and when MIRIELLO returned, approximately five to fifteen minutes l later, he reminded her, in what he described as a helpful, normal tone of voice., of the accountability of the sources. FROST advised that MIRIELLO got very angry and reminded FROST.that she did not.need him to tell.her how to do het job. FROST stated that her response angered him because he'was just trying to be helpful, so he told her that her lack of responsibility regarding source accountability could make the whole Dosimetry Section look bad, and he did not want to look bad as a result of her carelessness.

'. FROST stated that, at this point, another Bosimetry. Section Tech, John DEESE, told FROST to "back off." FROST advised that MIRIELLO then went back.into the respiratory /whole body count roce and,. according to .

CRUMBAUGH, M!AIELLO started throwing books and'-manuals 'around the room, awd .

made a statement to the effect that, "Doesn't FROST know that 1 read gun magazines?" FROST s'tated that he interpreted that statement M a threat,- -

when CRUMBAUGH told him about it, because some . . . .. ,. r- e. -

. FROST was displayed a photocopy of an NRC'Fors 4, entitled 0 cupational External Radiation Exposure History, signed "Patty S. MIRIELLO", dated May 20, 1985. This form had the initials "$MF" and 'VEP", both dated Wne 13, 1985, in7hrsectlon numbered 90, entW1Fd%emiFki"-- TR05T ' -- -

l l identified the "SMF" initials as his, and the "VEP" initials as Vera POE's.

FROST stated that he bad f.111ed out this form, in its entirety, before l MIRIELLO. signed it. .He -stated that he thought that MIPIELLO already had j the. records of exposure at Penn State University a'nd Three Mile Island

! was in the Dosimetry Section, and that David ELKINS was her supervisor when 1 she transferred to the Radwaste Section. FROST advised that he did not i . positively know the official reason for'MIRIELLO's tra.nsfer from Dosimetry 3

to Radwaste, but he thought it was because of the personality conflict '

,between, primarily, MIRIELLO and POE. l FROST advised that MIRIEll.0 was in Radwaste approximitely two months before

she was terminated. He stated that Kenny ELLIS was also in the Radwaste i .Section, and that ELLIS went to Brunswick Steam Electric Plant with l MIRIELLO, at the direction of ELKINS, jn order to get some actual working -

experience with Radiation Maste Materials, since BSEP was an operating Nuclear Plant and SHNPP had not loaded fuel yet. - -

. SHNPP since October 1984. She stated that she thought Patty MIRIELLO came into the section around February 1985. POE advised that MIRIELLO exhibited, a superior attitude to her'co-workers in the section right from the start,

  • and that there were parTicularly bad "vibes". between she (P0E) and

- MIRIELLO.~ POE stated that.the personality conflict wt so bad between she -

POE stated that, occasionally, she did stare at MIRIELL0; and she (POE) did

,, tend to crack her gum; and that she had accidentally bumped MIRIELLO while ~

. POE freely admitted that there was a personality confiict between her and- .

. MIRIELLO almost from MIRIELLO's fi.rst day in the Dosimetry. Sectton,.but.

that the incident MIRIELLO had' with FROST about the source accountability really angered MIRIELLO, and the situatio'n got' worse af ter that. POE also -

stated that she could have filed a formal c 1aint against MIRIELLO for calling POE a "Black Princess", but she (POE is not the type to go ~

. "running to management" with personality conflict problems. -

INVESTIGATOR'S NOTE: POE is of the Black race. -

POE was displayed a photocopy of an NRC Fors 4. Entitled "Occupational

- External Radiation Exposure History", signed "Patty S. MIRIELLO," dated May 20, 1985. This form had the initials "SMF" and "VEP"in Bloch 10 of the Form entitled Remarks. POE ident'ified the "VEP" initials as her's;-and stated'that the peaning.of her initials in Block _10 was a've'rification th&t .

to MIRIELLO's allegation of falsification of her (MIRIELLO's) Fors 4 whatsoever.

POE stated that she, FROST, and MIRIELLO would have been the only ones  !

involved in the processing of the NRC Form 4 displayed to her. She stated l that MIRIELLO personally did a lot of the follow-up of the request sent to North Carolina State University (NCSU) for her own (MIRIELLO's) exposure history at NCSU, but that there was no real need for an expediting of that information in order for MIRIELLO to do her job.

was interviewad in .the office of the NRC Resident Inspector by NRC l Investigator Larry L. Robinson. O'HALLORAN provided the following informa- l tion +1n substance: . .

~ i 0'HELLORAN stated that he has been employed by CP&L since 1971, and has been in the' Health Physics Sectio'n. since that time. ,  !

O'HALLORAN advised that, as the forema.n in the' Dos.inetry Section at SHNPP, he had an occasion. to supervise a female named Patty MIRIEiLO. He stated

. that MIRIELLO worked in the dosimetry section in early 1985 for approxi- -

mately six months. O' HALL.ORAN stated that imediately upon HIRIELLO's..

entry into the dosimetry section there, began to be' dissension betkeen the "

dosimetry technicians. O'HALLORAN' stated that- he had written a letter to

'- Jim McDUFFIE, his second Tine supervisor, outlining some of- these -

dissension problems between the technicians. O'HALLORAM . stated that John FERGUSON, who was formerly the personnel Officer at SHNPP, would be aware of these problems in the letter that O'HALLORAN had written to McDUFFIE. -

O'HALLCRAN s'tated that a specific example' of one of these problems was a -

' personality conflict between MIRIELLQ. and a black temale t'echfite.isn named s Vera POE. He stated that on one occasion, MIRIELLO and POE had gotten into an argument, and MIRIELLO ~had made the statement "doesn't that -black princess know that I know how to shoot a gun. I have the medals to prove it". .

O'HALLORAN stated that ' approximate-ly a month or 'two after'.the "black - '

princess' incident, NIRIELLO transferred into the Rad Vaste Group under the '

supervision of Da'vid ELKINS.' He stated that the reason for MIRIELLO's transfer from dosimetry to rad waste was because of the dissension she was creating in the dosimetry section. ,

O' Hall 0RAN stated that since MIRIELLO was transferring to the rad waste section, they decided to do the paperwork to get her a TLD badge. He stated that part of this paperwork involved filling out an NRC Form 4.

O'HALLORAh advised that he was not directly involved in the initial

. preparation of the Fors 4, and that a dosimetry technician by the name of John DEESE had fjlled out the initj IELLO. 0'liALLORAM advised that this Fors 4 indicated a ~

dose for MIRIELLO at -

. North Carolina State University'(NCSU .-

.0'HALLORAN stated that he ' recalled receiving 4-Tetter from the radiation -

monitoring' people at leCSU, stat.ing thatt MIRIELLO had not been monitored during her enrollme.nt at North Carolina State in 3. O'HALLORAN advised that when DEESE filled 6ut the Form 4 indjcating MCSU, MIRIELLO brought the form to him (0'HALLORAN) and told O' riod she that was she had in there, and.

fact been wearing a TLD at NCSU for t

. . said she wore a badge at NCSU, because people tend to remember when they Tl.Ds . O'HALLORAN stated that he told MIRIELLO that she could are request wearing't tha NCSU se' arch their records again for exposure data on MIRIE but that NCSU would probably come up with the same findings, namely that MIRIELLO had not been monitored.

'0'HALLORAN stated that evidently when 4tCSU rechecked r monitori r_ecords, they found that MIRIELLO did, in fact, receive

.from NCSU, he destroyed the original was incorrect., and had -

another Form 4 prepared showing th'e exposure .at NCSU..

. O'HALLORlui advised that M1RIELLO read his record of exposure

'., at NCSU, and signed the Form .4 showing the ose with no objection. . .

O'HALLORAN . stated'that, in his opinion, 'the 'only way that .MIRTElto could

. have possibly interpreted that anyone at CP&L was trying to force her ta sign a falsified form 4 was when he told her that if. CP&L asked NCSU to .

recheck their monitoring records', that they would,probably reply again that their records showed no monitoring for MIRIELLO in 1983.

O' Hall.ORAN caused his dosimetry files to be checked for a copy of the original ' letter from NCSU indicating that HIRTELLO had not been.. monitored, ~

but was unable to locate this letter. ,
