AFFIDAVIT OF NAN TERESA PICKARD I, Nan Teresa Pickard, do make oath and state:

(1) I am a paralegal employed by the Department of the Attorney General of the Commonwealth of Massachusetts.

(2) On Wednesday, June 8, 1988, the United States Court of Appeals for the First Circuit heard oral arguments in the matter of Commonwealth of Massachusetts v. NRC, No. 88-1121 in Boston, Massachusetts.

(3) On Thursday, June 9, 1988, I contacted Francis P.

Scigliano, Clerk, United States Court of Appeals tor the First Circuit, for the purpose of obtaining of copy of the Court's audio tape recording of the hearing referenced in paragraph 1.

Mr. Scigliano agreed to allow me to bring recording equipment to his office in the United States Post Office and Court House in Boston, Massachusetts, on that day (June 9, 1988) and make a copy of the aforementioned tape.

0 (4) I obtained an audio tape and two audio tape recorders from the Press Office of the Attorney General of the Commonwealth of Massachusetts and proceeded to Mr. Scigliano's office.

(5) I arrived at Mr. Scigliano's office at approximately 11:30 a.m. on Thursday, June 9, 1988. I spoke directly to Mr.

Scigliano and requested the court's tape of the hearing held on June 8, 1988 by referencing the relevant case docket numbers.

Mr. Scigliano handed me the tape and I verified the docket numbers on the tape.

(6) Mr. Scigliano then escorted me to a room on the fifteenth floor of the Court House. Mr. Scigliano helped me set up the recording equipment and requested that I return the court's tape to him when the copying was complete. Mr.

Scigliano then left the room and I proceeded to copy the previously referenced tape.

(7) I copied the tape in its entirety and returned the original tape to Mr. Scigliano, (8) I returned to the Attorney General's office with the copy of the tape. At that point portions of the tape were transcribed on June 9, 1988.
