Exhibit 4 is an unofficial transcript of portions of the oral argument held before the First Circuit on June 1
8, 1988 concerning the challenge to the Commissiot's now rule.
As the Affidavit of Nan Pickard, also enclosed, makes clear this transcription was done in the Mass AG's office from a j
tape of the audio recording of that argument in the possession of the Clerk of the First Circuit.
No official transcript of that argument. exists.
Enclosed with this letter is the audio tape copy Ms. Pickard made on l
June 9, 1988 which I used to produce the partial transcription set forth as Exhibit 4 and cited in our brief.
