SUBJECT:

NRC INTEGRATED INSPECTION REPORT 50-413/98-10 AND 50-414/98-10

Dear Mr. Peterson:

On October 31,1998, the NRC completed an inspection at your Catawba Nuclear Station. The

enclosed report presents the results of that inspection.

During the five-week period covered by this inspection, your conduct of activities at the

Catawba Nuclear Station was generally characterized by safety-conscious operations, as well

as adequate engineering, maintenance, and radiological controls.

Based on the results of this inspection, one violation with two examples was identified and was

considered for escalated enforcement action in accordance with the " General Statement of

Policy and Procedures for NRC Enforcement Actions" (Enforcement Policy), NUREG-1600.

The violation is discussed in Section S8.1 of the enclosed inspection report and involved the

]

failure to control personnel access into the protected area on September 13,1998, such that an

'

unauthorized Individual could have easily gained undetected access into vital areas. The NRC

has completed its review of the unauthorized access and entry of a terminated individual into

the protected area. We note that given the failure to control access through an established

security system, this violation would normally have been considered for categorization at

Severity Level lli in accordance with the Enforcement Policy. However, the isolated event

involved no actual threat by the individual to compromise plant security and, in fact the

Individual was unaware of his termination. Further, the risk significance was lessened by the

/

relatively short duration of the presence of the unauthorized individualin the protected area, the

'

recovery of the individual's badge, and the escorting of the Individual by plant security from the

protected area. Based on these considerations, the NRC has concluded that this issue is more

appropriately classified at Severity Level IV. The NRC recognizes that the event was self-

identified and actions were implemented to correct the violation; therefore, this non-repetitive,

licensee-identified and corrected violation is being treated as a Non-Cited Violation, consistent

,

with Section Vll.B.1 of the Enforcement Policy.
