Dear Ms. Ferster:
This is to inform you that the Staff acknowledges receipt of the New En0 and Coalition on Nuclear Power's "Second Set Of Interrogatories And 1
Request For The Production Of Documents To The NRC Staff On NECNP Contentions I.V and IV."
Inasmuch as NECNP has failed to comply with 10 C.F.R. 5 2.720(hi(ll),
the Commission's regulation which forbids interrogatories to the Staff in the absence of a finding that the interrogatories are "necessary to a proper decision in the proceeding" and "not obtainable from any other source," the Staff is under no cbligation to respond to any of the fin multi-parted interrogatories propounded by NECNP.
NECNP does not even attempt to explain why the discovery sought is necessary to a proper decision or uncbtainable from anottier source.
Nevertheless, end without walving its right to insist upon future comp!Iance with the Commission's Rules of Practice, the Staff will respond to NECNP's interrogatories within the next thirty days,
