HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING JUNE 10, 1988 West Valley Demonstration Project The first campaign of supernatant processing at the West Valley Demonstration Project coninenced on May 23, and finished on May 27, 1988. The supernatant treatment system, designed to remove at least 99.9 percent of the dissolved cesium from the high-level waste supernatant, appears to have performed successfully. About 35 campaigns will be required to process all of the supernatant at West Valley. The treated supernatant will be mixed with cement and solidified in drums as low-level waste. The cesium, as retained by the zeolite ion exchange media, will be stored for future incorporation in borosilicate glass.

International Cooperation on Cesium Event On Friday GPA/IP advised the Atomic Energy Control Board (AECB), the NRC regulatory counterpart in Canada, that products which had been processed at Radiation Sterilizers. Inc. (RSI) in Decatur, Georgia had been shipped to Canada. IP also briefed AECB of the general situation at RSI and identified the destination of the products so that the AECB could take appropriate action.

Referendum on Rancho Seco On June 7, 1988 Sacramento area voters rejected ballot Measure B, a proposal to shut down the Rancho Seco facility, by a narrow 50.5% to 49.5% margin.

Ballot Measure C, a proposal to permit continued operation for an 18-month trial period, was _ approved by Sacramento Municipal Utility District voters by a vote of 51.5% to 48.5%.

NRC Comission Hearings Now on Closed-Circuit TV With the hookup of NRC's broadband broadcasting system, some of the Comission meetings held in the main Hearing Room are now being broadcast in-house. They may be viewed on Channel 47 on any TV monitor in the building.

The licensee announced on June 2, 1988 that William T. Cottle has accepted the position of site director for the GGNS to replace J. Cross who went to Turkey P

  • t last month. The GGNS Unit 1 plant manager, training superintendent, si60 controller, manager of special projects and manager of plant modification and construction will report to Mr. Cottle. Mr. Cottle will assume responsi-bilities as site director in about one month after training and familiarization with the GGNS organization, major initiatives and the management system. Mr.

Cottle is presently manager of nuclear safety oversight for the Middle South Utilities (MSU) Nuclear Assurance group. He joined MSU in March 1987 after 20 years of nuclear experience in the Nuclear Navy, Alabama Power Company, the NRC and TVA. Mr. Cottle was formerly site director of the Watts Bar Nuclear Plant.

PILGRIM - INTERIM DIRECTOR'S DECISION UNDER 10CFR 2.206

!- On May 27, 1988 Dr. Murley signed an Incerim Director's Decision in response i

to the October 15, 1987 Petition regarding Pilgrim filed by Massachusetts i Governor Michael S. Dukakis and others.

The Petitioners requested that the Director institute a 2.202 proceeding to modify, suspend or revoke the Pilgrim operating license until the licensee demonstrates that the issues raised by the Petitioners have been esolved.

The issues were (1) perform a Pilgrim-specific PRA and implement all identified safety modifications, (2) conduct a full hearing on significant issues and prepare emergency plans that are certified by outstanding safety the Governor, and (3) block the power ascension program until a formal hearing is held and findings of fact are made concerning safety questions that have been raised.

The relief sought by the Petitioners is based on allegations of (1) evidence of continuing serious managerial deficiencies at Pilgrimi (2) evidence that a i

I plant-specific PRA, as well as the implementation of any safety modifications l

indicated thereby, should be required prior to restart, and (3) evidence that the state of emergency preparedness does not provide reasonable assurance that adeouate protective measures can and will be taken in the event of a radiological emergency during operations.

The Director's Interim Decision provides the following conclusions:

1. The NRC has required, and will continue to require, that Pilgrim remain shut down until the management and errergency preparedness issues are dealt with to the satisfaction fo the NRC.
2. A decision can not be made at this time regarding the management issue.

That portion of the Petition will be addressed in a subsequent response.

ENCLOSURE B JUNE 10, 1988 ,

3. The Petitioners provided no substantial new evidence that was not known to the NRC when it issued the Golden Interim Decision regarding the management issue at Pilgrim.
4. The Petitioners did not identify any unique or unacceptable severe accident risk for the Pilgrim plant, nor document that such risk poses an unreasonable threat to public health and safety. Thus, Petitioner's request that restart be delayed until a PRA is conducted is without merit.

Pilgrim is presently shut down. The licensee expects to be ready to restart the plant in August 1988.

(Palo Verde Units 1, 2 and 3)

We have been informed by the Arizona Public Service, ANPP licensing manager William Quinn that Mr. Edward Van Brunt, Executive Vice President for ANPP will retire effective August 1, 1988. Subsequently, he will provide consulting services during the current pending hearings on Palo Verde. We understand Mr. D. Carner will be selected to fill the Executive Vice President position.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending June 10, 1988 LOW-LEVEL WASTE MANAGEMENT L y level Waste Final Closure Agreement Reached for Sheffield, Illinois, Low-level Nuclear Waste Disposal Facility ',LLWDF)

On May 25, 1988, USEcology (the site operator) and tM State of Illinois (an Agreement State) settled out-of-court on the tenns for final closure of the Sheffield LLWDF. This out-of-court settlement concludes a claim made in 1978 by the State of Illinois against USEcology for $97 million. The cost of the settlement agreement is estimated to be $8 million, which includes funds already spent by USEcolngy, a $1.65 million escrow account for construction costs, and a $2.5 mill 1on dollar long-term custodial care fund. The terms for final closure include: capping of the site, installation of new monitoring

. wells, and removal of some old wells. USEcology agreed to stay on the site for the next 10 years'in order to finish construction on the site and then provide post closure care.

INDUSTRIAL AND MEDICAL NUCLEAR SAFETY Fuel Cycle Safety Accident Analysis Handbook The Nuclear Fuel Facility Accident Analysis Handbook, prepared in a cooperative effort by Pacific Northwest Laboratory, Los Alamos National Laboratory and IMNS staff, was issued as NUREG-1320. The Handbook provides improved methods of evaluating the consequences of accidents in fuel cycle facilities. It is in-tended for use by NRC staff as well as applicants for licenses and license l

I amendments. The handbook is designed to accomodate further information related to accident analyses as it is developed.

2 SAFEGUARDS Domestic Briefing by DOE /Hanford On Training of Licensee Guards There will be a briefing at 2:00 p.m., June 15, 1988 in WFN Conference Room 4B11, by DOE /Hanford personnel on the usa of the Hanford site for training NRC licensee guards. The purpose of the briefing is to determine if NRC might be interested in suci: a course. OFFICE OF NUCLEAR REGULATORY RESEARCH l items of Interest Week Ending June 10, 1988 RES RULEMAKING HIGHLIGHTS Disposal of Radioactive Wastes (10 CFR 61)

Proposed amendments to Part 61 have been published for public comment that would require geologic repository disposal of all above Class C low-level radioactive waste (LLW) unless an alternative has been approved by the Commission. This action stems from the ANPR on HLW definition, and is being taken in lieu of any revision in the definition of HLW.

The proposed rulemaking was published in the Federal Register on May 18, 1988 (53 FR 17709). The public comment period is scheduled to end July 18, 1988.

Night Firing Oualifications for Security Guards at Nuclear Power Plants (10 CFR 73)

On December 16, 1987, NRR requested that RES initiate a rulemaking regarding night firing qualification of licensee guards at power reactors. The EDO approved this rulemaking for fo'tiation on May 18, 1988.

Licenses and Radiation Safety Reauirements for Large Irradiators (10 CFR 36)

The Nuclear Regulatory Commission is developing regulations to specify radiation safety requirements and license requirements for the use of licensed radioactive materials in large gamma irradiators. Gamma irradiators use gamma radiation to irradiate products to change their characteristics in some way.

The requirements would apply to large panoramic irradiators (those in which the radioactive sources and the material being irradiated are in a room that is accessible to personnel while the source is shielded) and certain 13rge i self-contained irradiators in which the source always remains under water.

The rule would not cover small self-contained irradiators, instrument calibrators, medical uses of sealed sources (such as teletherapy), or l

non-destructive testing (such as industrial radiography).

This rulemaking was approved for initiation by the ED0 on May 5,1988.

2 Emergency Planning and Preparedness Requirements for Nuclear Power Plant Fuel Loading and Initial Low-Power Operations (10 CFR 50)

The Nuclear Regulatory Comission proposes to amend its regulations to establish more clearly what emergency planning and preparedness requirements are needed for fuel loading and low power operation of nuclear power plants.

The proposed rulemaking was published in the Federal Register on May 9, 1988 (53 FR 16435). The public coment period was scheduled to end June 8,1988; however, an extension to June 23, 1988, has been granted (53 FR 19930).

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending June 10, 1988 Diagnostic Evaluation and Incident Investigation The NRC evaluation team completed its initial draft of the IMA evaluation report and met on June 10 to discuss and resolve t" oments on the draft report. On June 9, the Director, AE0D; and Division Dbs tr,, DOA (Team Manager), met with the Regional Administrator, Region II; Associale Director for Projects, NRR; and with ENERCON representatives in attendance, met with the FP&L senior executives at the FP&L corporate offices in Miami to present and discuss the results of the NRC Team's evaluation and recommendations, and NRC's planned follow-up actions.

Incident Response On June 7, the Direc'a r and Deputy Director, AE00, and Branch Chief, IRB met with NUMARC representatives to discuss the Emergency Response Data System (ERDS) and the impact of pending ERDS legislation. The NUMARC representatives were also given a tour and briefing of the Operations Center.

Reactor Operations and Analysis

. AE0D concerns regarding the March 9, 1988 power oscillation event at Laralle 2, special report AE00/S803, was issued on June 7, 1988. The LaSalle event was significant because the large power oscillations experienced were not predicted by design analysis, unanticipated by the operators, and potentially in conflict with GDC 12. Because analyses predicted that these oscillations would not occur, little guidance and training were provided for operator detection and response at LaSalle. The event also has generic implications because similar stability analyses are used at many BWRs and these stability analyses were used to resolve GIs B-19 and B-59.

The report described the event and the history of the BWR thermal / hydraulic instability issue. The report concluded with a list and description of AE00 concerns and associated recommendations for short and long term remedial actions.

t The short term remedial recommendations, pending a full understanding of this event and its implications are to require BWRs to:

a. Immediately insert control rod to below the 80% rod line following any transient which results in entry into potentially unstable areas of the BWR power / flow map.
b. Avoid routine entry into potentially unstable areas of the power / flow map during reactor startup and shutdowns by implementing changes to operating

! procedures.

c. Immediately scram the reactor if (a) of (b) above are not successful in preventing and suppressing oscillations.

The long term remedial action recommendations are to revisit GIs B-19 and B-59 and ATWS mitigation in light of the LaSalle operating experience.

ITEMS OF INTEREST OFFICE OF GOVERNMENTAL AND PUBLIC AFFAIRS WEEK ENDING JUNE 10, 1988

' INTERNATIONAL PROGRAMS Foreign Visitors On Wednesday Dr. Jean Tourte, a medical 6ctor at the French Marcoule nuclear research center, met with Al Roecklein and other members of the Radiation Protection and Health Effects Branch, RES, to discuss occupational exposure regulations in the U.S.

On Thursday and Friday Messrs. Antonio de Acha and Alfonso Lopez Arroyo of the Consejo de Seguridad Nuclear (CSN) in Spain and Mr. Antonio Jimenez from the Spanish Geographic Institute met with NRR and NMSS staff to discuss seismic reassessment of the Almaraz NPP and current NRC policy on geologic and seismic criteria in nuclear facility siting and radwaste storage and disposal. The CSN team also gave a presentation on seismicity and seismic hazards in Spain.

Also on Thursday and Friday Mr. Fernando Robledo of the CSN held discussions with RES staff on topics related to containment. Similar discussions are

- scheduled with NRR on June 13.

STATE, LOCAL AND INDIAN TRIBE PROGRAMS l

Leaking WESF Cesium-137 Source (s) - Status Sumary The State of Georgia informed Region II on June 7,1988 of a leaking Waste Encapsulation Storage Facility (WESF) Cesium-137 source at Radiation Sterilizer, Inc., (RSI), an agreement state licensee located in Decatur, Georgia. RSI irradiates medical products and packaging for food containers.

The RSI 1rradiation facility has 252 capsules containing Cesium-137 with activities between 43,000 to 50,000 curies each in a 25-foot deep foot pool.

The sources were produced by DOE from their Waste Encapsulation Storage Facility (WESF) and are leased by DOE as WESF irradiator sources.

Preliminary investigations indicate that one or more of the WESF source capsules are leaking. The leaking sources w3re discovered sometime after June 3, 198P,, although there may have been instances of product contamination JUNE 10, 1988 ENCLOSURE F

2 between April 29, 1988 and this time. Staff of Georgia's Department of Human Resources were immediately dispatched to the facility. They detennined that while the radiation levels were relatively high above the storage pool, this area was contained and did not pose a danger to the public.

The early morning of June 9,1988, the staff of Georgia's Department of Natural Resources and NRC Region II staff visited the facility to determine whether or not any risk existed outside the building. The levels found outside the RSI facility were essentially natural background. For additional information see PN-II-88-40 PN-II-88-40A and PN-II-88-40B.

Governor Joe Frank Harris issued a statement on June 9,1988. Since any potential exposure to the public would only occur if any of the Cesium leaked intc environment, the Governor has designated the Department of Natural Rest 3 as the lead Sthte agency in monitoring and coordinating these investigations. Also the Governor announced that the levels found outside the RSI facility were esseni.'elly at natural background levels and pose no public health problem.

The State and NRC had a meeting in the afternoon of June 9, 1988 with the licensee to discuss the contents of the recovery plan. The plan will consist of:

1. Obtaining the necessary technical expertise to isolate and recover a leaking source. The State plans to contact DOE for assistance in this area.

2. Performing comprehensive surveys and initiating necessary cleanup to decontaminate the interior of the building.
3. Have bioassays and urinalyses performed on all licensee employees.
4. Initiate surveys on workers clothing, automobiles, and places of residence.

Office of .imall ar.d Disadvantaged Business Utilization / Civil Rights Items of Interest Week Ending June 10, 1988 In concert with the NPC Consolidated EE0 Program Plan, the Office of Small and Disadvantaged Busine:s Utilization and Civil Rights (OSDBU/CR) hosted the agency's fifth annual EE0 Counselor's training conference in Bethesda, MD, on June 1, 2 and 3, 1988. Twenty (20) headquarters and regional EE0 Counselors came to partake in the training activities and received a wann and inspiring welcoming address from the OSDBU/CR Director, Bill Kerr.

Key officials from the Equal Employment Opportunity Comission (EE0C) conducted workshops on the Federal Sector Complaint Processing Manual; age discrimination; duties, authority and responsibilities of EE0 Counselors; and avoiding sexual harassment, including sexual harassment case law. NRC officials from the Office of Personnel conducted workshops on personnel policies and practices; EE0 Counselors' access to personnel records; and the employees grievance system, from the agency's perspective. A representative from the National Treasury Employees Union (NTEU) discussed employee's emp'oyment rights; the NRC/NTEU Collective Bargaining Agreement; l

and the employee's grievance system, from NTEU's perspective.

On the last day of the conference, the group met with the NRC Chairman, l

Landow W. Zech, Jr., and Victor Stello, Jr., the Executive Director for Operations, who commended them for their EE0 collateral efforts and provided words of encouragement for the future. A Proposed Imposition of Civil Penalty in the amount c. $50,000 was issued on June 3, 1988 to Tennessee Valley Authority (Sequoyah Unit 2). The action was based on failure to maintain the required number of centrifugal charging pumps operable in an operational mode in which they were required and a failure to promptly report this condition as required. An Order Modifying License and Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $5,000 was issued on June 3, 1988 to Riverton Memorial Hospital - Health Trust, Inc., Riverton, Wyoming. The action was based on unauthorized use of licensed material, failure to instruct individuals, and various other violations, four of which were repeats of the previous inspection findings. The Order Modifying License requires notifications to the NRC of personnel terminations, obtaining an independent consultant to assess the program and perform audits. (EN 88-44)

- A Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on June 3,1988 to V. A'. Medical Center, Northport, New York. The action was based on failure to perform output spot checks on the teletherapy unit or maintain records of these checks, failure to notify NRC of RS0's employment termination, failure to monitor for hand contamination, and other violations of NRC requirements. A Proposed Imposition of Civil Penalty in the amount of $27,500 was issued on June 6,1988 to Milford Memorial Hospital, Milford, Delaware. This action was based on (1) the falsification of records of constancy checks of the isotope dose calibrator b to December 17, 1986; (2)y thetwo technologists initial deliberate from denialapproximately May 6, 1986 of that falsification by a nuclear medicine technologist during the inspection; (3) the falsification of the Radiation Safety Comittee (RSC) meeting minutes for several years by the former Radiation Safety Officer; and (4) the submittal of falsified RSC meeting minutes to the NRC for review during several inspections, and in support of license renewal on one occasion. An Order Modifying License and Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on June 7,1988 to Hospital Metropolitano, San Juan, Puerto Rico. 0FFICE OF CONSOLIDATION Items of Interest Week Ending June 10, 1988 Art Program As part of its program to provide quality surroundings at One White Flint North, the Office of Consolidation has begun to install works of art in the building. Under the direction of an art consultant, original paintings, etchings, lithographs, and artists' photographs are being installed in conference rooms. Posters are being hung in corridors and other public areas. In keeping with NRC's mission to preserve the environment, the overall theme for i.he art program is nature, the environment, and plant and animal life.

Mailbox A mailbox for deposit of outgoing U.S. Postal Service mail has been installed on the first floor of OWFN in the corridor between the future .

NRC Conmission Hearings Now on Closed-Circuit TV With the hookup of NRC's broadband broadcasting system, some of the Commission meetings held in the main Hearing Room are now being broadcast

GSA Officials Tour The new Administrator of GSA, John Alderson, toured OWFN on June 9. He t was accompanied by his chief of staff, Mr. Godfrey; the GSA Regional l Administrator, Richard Hadsell; and the Deputy Regional Administrator, Paul Christolini. The group was favorably impressed with the building.

1. On June 7, Regional management met with the Chairman and Chief Executive Officer of the Carolina Power and Light Company, and members of his staff, to discuss CP&L management overview of the company's nuclear program.
2. On June 9, the Regional Administrator; L. Reyes; E. Jordan and L. Spessard, AEOD, were at the Florida Power & Light Company's corporate office to present results of the AE0D findings regarding the ENERCON report. On June 10, the monthly management meeting held at the Turkey Point site.

1 3. On June 9, the Deputy Regional Administrator held the firt.t meeting of the Hatch lessons learned task force. The meeting included Fred Hebdon, NRR, and selected members of the Regional staff. Gus Lainas, NRR; Larry Crocker, NRR; i

Tom Novak, AEOD; and Bill Troskoski, EDO, participated by telephone. The schedule established estimates issuance of t the final report by the end of August. ,

4. On June 9,1988, a Regional radiation specialist and a State representative conducted a survey external to the Radiation Sterilizer, Inc. (RSI) facility in Decatur, Georgia. The results of this survey indicate no significant spread of contamination outside the building. Activity levels measured were only slightly above background. A meeting with NRC and State officials was conducted to develop an overall recovery plan. Technical support for the recovery plan will be provided by DOE (Savannah River). The Governor issued a press release, and the Region issued an update (PNO-II-88-408).

REGION IV ITEMS OF INTEREST Week Ending June 10, 1988

1. The Fort Calhoun SALP Board, composed of members of Region IV and NRC headquarters staff, met in Region IV on June 7,1988.
2. Members of Region IV and the NRC headquarters staff met with Omaha Public Power District personnel on June 8,1988, to discuss the failure of the instrument air system accumulator check valves to meet desi requirements and the containment pressure instrument line (gn basis 3/8-inch)which was left open to the outside atmosphere for over a year. This meeting was conducted at the Region IV office in Arlington, Texas.
3. Pursuant to Part 9.200, the minority owners of Comanche Peak have made a request to the General Counsel for testimony from, among others, several l

RIV employees, including the Regional Administrator. Such testimony will I be used in the civil litigation between the minority owners and TU Electric.

! about conditions at Comanche Peak. Any official NRC position will be made l by OSP prior to its decision on whether or not to recomend the grant of

5. An enforcement conference is being held today with Bill Miller, Inc. at the NRC Region IV offices. The purpose of the enforcement conference is to discuss the February 27 and May 11, 1988, inspection findings. The February inspection was conducted to ascertain whether nonlicensee personnel were overexposed to a radiographic gama source at the Wynnewood Refinery in Oklahoma when the licensee failed to control access to a restricted area. Subsequent cytogenetic analyses and calculations <

based on reenactments of the event revealed that one nonlicensee worker received an exposure in the range of 200 to 460 mR.

  • Section 201 of the Energy Reorganization Act, 42 U.S.C. S 5841, provides that action of the Commission shall be deter-mined by a "majority vote of the members present." Commiesioner Carr was not present when this item was affirmed. Accordingly the formal vote of the Commission was 3-0 in favor of the decision. Commissioner Carr, however, had previously indicated that he would approve this paper and had he been present he would have affirmed his prior vote.
