Dear Senator Hatch:
I am writing to reply to your letter dated September 28, 1988 on beha'if of the Department of Physics at Brigham Young University (BYU), regarding their nuclear research reactor.
As backgrounds operations at the reactor facility ended in May 1982, and the reactor fuel was returned to its owner, the Department of Energy, in May 1987. The NRC staff is working closely with the Brigham Young Campus Safety Office so that a possession-only amendment to the BYU facility operating license can be issued as soon as possible. Once the possession-only amendment has been issued, Brigham Young can submit an application to decommission the reactor facility and terminate the facility license.
The staff will continue to work closely with BYU so that a decomissioning application outlining how BYU will disassemble the facility, dispose of radioactive and contaminated material, and return the facility to unrestricted use can be submitted and reviewed by the HRC staff and approved. This will allow an order to be issued authorizing BYU to carry out the decommissioning. The NRC will review and verif'y the results of the decomissioning work, so that a second order could be issued to terminate the reactor license.
I want to assure you that the overall effort is proceeding in a cooperative fashion. NRC will continue to give this matter close attention so that the license can be terminated expeditiously, which would allow the indemnity fee of $100.00 per year to be no longer required.
