MEETING BETWEEN BWXT/ ARCO AND NRC STAFF ON MAY 20, 1999 License No SNM-414, Docket No. 70-364 License No. SNM 2001, Docket No. 70-3085 On May 20,1999, staff of the Nuclear Regulatory Commission (NRC) met with staff of BWX Technologies (BWXT) and the Atlantic Richfield Cornpany (ARCO) at NRC headquarters in Rockville, MD. The purpose of the meeting was to discuss the Citizen Advisory Panel (CAP) Action Plan for the Parks Township, Shallow Land Disposal Area (SLDA) and the status of the j decommissioning of the Parks Operating facility (PTS), both of which are located in Parks - Township, PA. In addition to NRC and BWXT/ ARCO staff of the Pennsylvania Department of Environmental Protection (PADEP) also participated in the meeting. The meeting was announced in accordance with NRC requirements in Management Directive 3.5 and was open to observation by interested members of the public. Five members of the public observed and participated in the meeting. Attachment 1 is the Attendee List for the meeting and Attachment 2 is the meeting Agenda, j DISCUSSION OF THE CAP FOR THE SLDA 4 The meeting began at approximately 9:00 a.m., and generally followed the attached agenda. BWXT/ ARCO staffs presented an overview of their previous and ongoing public information activities and then described their proposed Action Plan. In response to concerns by NRC, PADEP, and members of the public, BWXT/ ARCO indicated that they were undertaking the CAP as part of an evaluation of all alternatives for decommissioning. BWXT/ ARCO further stated that they had not yet determined which decommissioning alternative they would request, but were forming the CAP and undertaking activities to comply with 10 CFR 20.1403 now in order to meet the requirement to submit the decommissioning plan for the SLDA by December 6,2000. BWXT/ ARCO indicated that they would not complete the evaluation of all potential decommissioning alternatives until later in 1999 and would not make a decision on which alternative they would request until the evaluation was completed. I f ta R. Nelson 1 N'RC and PADEP staff had the following comments about the proposed CAP Action Plan:
- 1. BWXT/ ARCO should ensure that all individuals and institutions that could be affected by the decommissioning be represented on the CAP. This would include those indicated on the proposed CAP, as well as others in the local community, such as environmental /public interest groups, all local school boards, and agricultural interest groups.
- 2. The Action Plan indicates that, if the CAP cannot meet the schedule for completing the ,
reviews required under NRC regulations at 10 CFR 20.1403, BWXT/ ARCO will not delay subsequent actions necessary to submit a decommissioning plan for the SLDA. NRC staff stated that it would be BWXT/ ARCO's responsibility to ensure that the information required in 10 CFR 20.1403 was included in tbe decommissioning plan and that the NRC staff would not accept inactivity on the part of the CAP as a reason for delaying the submission of the decommissioning plan or an incomplete decommissioning plan.
- 3. NRC staff stated that it was not clear in the CAP Action Plan if the publicly available summaries required under 10 CFR 20.1403 (d) (iii), would be prepared or distributed.
BWXT/ ARCO stated that they recognized this requirement and that it would be addressed in the CAP operating procedures.
- 4. NRC staff cautioned BWXT/ ARCO that NRC did not expect licensee's to assume that license termination under restricted use conditions would be authorized without the licensee first making all of the demonstrations required under 10 CFR 20.1403. The NRC staff also encouraged BWXT/ ARCO staff to review Draft Guide DG-4006 and a draft Standard Review Plan module on restricted use that the NRC staff was preparing to ensure that BWXT/ ARCO was aware of the staff's expectations concerning the ,
demonstrations necessary to request license terminations under restricted use.
- 5. NRC staff urged BWXT/ ARCO to review the Statements of Consideration for 10 CFR 20 Subpart E (the License Termination Rule) regarding restricted use, particularly those pertaining to institutional controls, in order that BWXT/ ARCO would understand the type of institutional controls the NRC staff would expect, if BWXT/ ARCO requested license termination under restricted use conditions.
- 6. NRC staff urged BWXT/ ARCO to keep NRC and PADEP staff informed of the progress and results of the CAP, as well as the dates of CAP meetings. NRC staff stated that,if appropriate, it would be available to participate in a CAP meeting to explain the NRC regulations and decommissioning process. However, NRC staff would not be available to routinely attend CAP meetings and would not participate in the CAP evaluations or discussions.
Members of the public had the following comments on the CAP:
- 1. B' forming the CAP, BWXT/ ARCO could be seen as choosing the decommissioning alternative without completing the alternatives analysis. This could hinder BWXT/ ARCO efforts to recruit members of the community to serve on the CAP;

, Si BWXT/ ARCO should v.aluate potential doses associated with restricted use and -l ensure that restricted use results in doses that are as low as reasonably achievable; l - 4. BWXT/ ARCO should consider' PADEP's low-level radioactive waste (LLRW) disposal i facility siting criteria, including the criteria for excluding areas for consideration as LLRW disposal. facilities, as.they evaluate the alternatives for decommissioning the SLDA. ) NRC staff also reminded BWXT/ ARCO staff of the NRC staff's intention to hold periodic-meetings at appropriate milestones in the development of the decommissioning plan. These p meetings would be open to observation by members of the public, and some of these meetings l_ would be held in the Parks Township area. I BWXT/ ARCO staff indicated that it would review the schedule for developing the Decommissioning Plan and contact NRC staff to discuss further meetings.- The portion of the meeting devoted to the SLDA concluded at approximately 10:15 a.m. STATUS OF THE DECOMMISSIONING OF THE PTS j At approximately 10:30 a.m., NRC, PADEP and BWXT staff m'et to discuss the status of the decommissioning of the PTS. This meeting was held at the request of BWXT and was one of j i the semiannual NRC/PADEP/BWXT management meetings for the PTS. The meeting !

R. Nelson 4-de'commi'ssioning. Attachments 3, and 4 are, respectively, the revised schedule for the decommissioning and the slides used by BWXT staff during its presentation. Several issues were discussed after BWXT staff concluded its overview of the status of the ; decommissioning of the PTS. These issues are summarized below. Volumetric Release of Roofs - BWXT has requested NRC approval to dispose of the Building B Hafnium and Machine Shop roof based on a demonstration that, when evaluated on a volumetric basis, the material will not result in doses to the public in excess of NRC public dose limit. NRC staff indicated that it was still reviewing BWXT's request. Orphan Waste Disposal - BWXT staff indicated that it had significantly reduced the volume of Mixed Waste (MW) and GreateNhan-Class C (GTCC) waste at the site, but that some MW and GTCC waste would be generated nu?qg decommissioning. BWXT staff requested that,if NRC , was aware of any disposal options for tr ls waste, NRC inform BWXT. NRC staff indicated that, if it became aware of disposal options for this waste, they would inform BWXT. NRC staff also suggested that BWXT staff explore the possibility of transferring any MW or GTCC waste that cannot be disposed of within the current decommissioning schedule to BWXT's Lynchburg, VA facility. However, NRC staff cautioned that, if BWXT intended to pursue this option, it should so inform NRC staff as early as possible and plan to coordinate the transfer with all other ! appropriate authorities. f Outfall 3 - BWXT staff requested that NRC staff expedite the review of the final survey for the Outfall 3 area. NRC staff indicated that the final survey report for the 1996 remediated areas, as well as, the Outfall 2/3 remediation plan were undergoing health physics review and that the staff hoped to complete the review within a week. Soil Confirmatory Surveys - BWXT requested insights into NRC and PADEP staff plans for conducting soil confirmatory surveys in and around Buildings A-C. NRC staff indicated that it had not yet determined whether NRC staff or contractors would perform the confirmatory surveys and could not estimate confirmatory survey report turn around times. However, NRC and PADEP staff suggested that BWXT perform final radiological and chemical surveys of the bottom of all excavr.tiocs before starting on the surveys for the entire Survey Unit. NRC and PADEP staff could toen perform confirmatory surveys for radiological and hazardous chemical contamination and if the excavation was found to meet the unrestricted release criteria allow BWXT to backfill the excavations. BWXT could then perform surveys for the surface soil. BWXT indicated that this would help address surface water concerns and allow them to proceed with the decommissioning in a timely manner. Intermodal Rail Shipments - BWXT requested that NRC allow a variance from the reporting requirements under 10 CFR Part 20 Appendix G 111 (E) 1 and 2 as the radioactive waste shipments to the Hanford disposal facility routinely took longer than the 20 days prescribed in the regulations. Under separate cover, BWXT presented a description of the circumstances surrounding the waste shipments and NRC staff indicated that they would review the issue and formally respond to BWXT's request.

Nelson Renewal'of License No. SNM-414 BWXT indicated that License No. SNM-414 would expire before the decommissioning of the site was completed, and requested NRC's staff insight into the most appropriate method to renew or extend the license. NRC staff discussed the request with BWXT staff and indicated that they would prepare a formal response to BWXT's request. During the meeting, BWXT staff requested that NRC, PADEP and BWXT increase the frequency of the meetings from semiannual to three times per year in order to address the issues associated with decommissioning of the PTS in a timely manner as the decommissioning project came to an end.
