Dear Mr. Lamastra:

As discussed with Mr. Steven Mars of my office, enclosed for your review is an advance copy of a public notice for the subject appifcation and some material the applicant has provided regarding the presence of radionuclides in the proposed dredged material and an evaluation of that presence.

We request your review and evaluation of the applicant's submitted material.

In particular, we request your opinion on the applicant's position that the material present is ' equivalent to normal background counts and poses no danger to the environment.

If at all possible, it would be appreciated if you could provide us your thoughts in writing prior to the close of the public notice comment period indicated on the top of page one of the attached public notice.

Your comments can also be submitted to Mr. fiars by telephone (212) or FTS. 264-3912 during this period with a confirming letter to follow.

If additional time is necessary, please call and we will hold our permit decision in abeyance until we receive your report.

The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources.

The benefit which reasonably may be expected to accrue from the activity must be balanced against its reasonably foreseeable detriments.

All factors which may be relevant to the activity will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlif e values, flood hazards, flood plain values, land.use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, saf ety, food production and, in general, the needs and welf are of the people.

ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise it will be presumed that there are no objections to the activity.

Any person may request, in writing to the district engineer, before this poblic notice expires, that a public hearing be held to collect information necessary to consider this application. Requests for public hearings shall 5

state, with particularity, the reasons why a public hearing should be held.

It should 'be noted that inf ormation submitted by mail is considered just as as that carefully in the permit decision process and bears the same weight furnished at a public hearing.

DESCRIPTION OF WORK A

The applicant, Long Island Lighting Company (LILCO), has requested Department of the Army authorization to repair existing jetties and embankment structures and dredge with ten year maintenance a portion of Wading River Creek and the intake canal of the LILC0 Power Plant at Shoreham, with disposal as beach nourishment in Long Island ' Sound at Wading River, Suffolk County, New York for the purpose of maintaining adequate depths for plant operation and safe passage for recreational vessels.

The work would involve the repair of existing armor-stone jetties adjacent to the plants intake canal and Wading River Creek, repair of several embankment and riprap structures within the confines of the plant, and the annual maintenance dredging of the plants intake canal of approximately 2500 cubic yards of material each year, to a depth of a minimum of twelve feet below the line of mean low water.

Disposal of the material would occur between the lines of. mean low water and mean high water of an adjacent beach located east of Wading River Creek.

The disposal area would extend easterly from the entrance of Wading River Creek, for a distance of 3100 linear feet to an existing stone groin located directly opposite of. the point where Creek Road intersects with Sound Road.

The work also involves annual maintenance dredging of Wading River Creek of approximately 4500 cubic yards of material each year to a depth of three feet below the line of mean low water.

The proposed dredge area would begin at an existing concrete launching ramp at Creek Road and terminate seaward of the entrance of Wading River Creek, where it meets Long Island Sound.

All dredged material would be placed as beach nourishment as described above.

The work described in this application received approval from the Corps of Engineers under a previous ten-year maintenance permit which has since expired.

Pursuant to Section 7 of the Endangered Species Act (16 U.S.C.

1531) and

~~ based upon a review of the latest published version of the threatened and endangered npecies listing, a preliminary determination is that the activity under consideration will not affect those species listed or their critical habitat.

Based upon a rev,iew of the latest published version of the National Register of Historic Places, there are co known sites eligible for or included in the Register within the permit area.

Pre s e n t ly unknown archeological, scientific, prehistorical or historical data may be lost by work accoc:plished under the required permit.

Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of the guidelines, promulgated by the Administrator,

U.S. Environcental Protection Agency, under authority of Section 404(b) of the Clean Water Act and the applicant will obtain a water quality certificate er waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior to a permit decision.

Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as amended (16 U.S.C. 1456(c)), for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit applicatien that the activity complies with and will be conducted in a manner that is consistent with the approved state coastal zone management program. By this pablic notice, we are requesting the state's concurrence with, objection to, or waiver of the applicant's certification.

No permit decision will be made until one of these actions occur.

For activities within the coastal zone of New York State, the applicant's certification and accompanying inferm.ation is available from, and any comments on, should be addressed to the New York State Department of State, Division of Local Government and Cennunity Services, Coastal Management Program, 162 Washington Avenue, Albany, New York 12231 Telephone (518) 474-5063.
