Gentlemen:

In Reference (b), New Hampshire Yankee (NHY) comitted to in..sil an ATWS Mitigation System, as required by 100FR50.62, and to have it functional prior to startup from our first refueling outage, no later than July 1989.

Additionally, NHY had comitted to provide plant specific design information required by 10CFR50.67, six months prior to the refueling outage.

NHY recognizes that at the time this comitment was made, it was anticipated that a full power Operating License would be granted within a time frame such that the first refueling outage would occur prior to July of 1989.

However, due to the licensing delays which have occurred, it is now certain that the first refueling outage will not occur prior to July 1989.

New Hampshire Yankee therefore requests that this comitment be clarified and revised to reflect that the ATWS Mitigation System will be installed and functional prior to startup from the first refueling outage.

Recognizing the possibility that issuance of a full power license is conceivable for early or mid-1989, the implementation of the ATWS mitigation package may well be coincident with full power authorization and the activities assou.ated with ascension to full power.

Since Seabrook Station must be shutdown for installation of this system, revising ti *.s comitment will avoid the planning, scheduling, and implementation activities of this significant design modification from impacting or interfering with the startup test program.

Furthermore, maintaining the present comitment increases the potential of this design change to delay comercial operation.

Document Control Desk Page 2 Due to the potential impact on startup and full power ascension, NHY requests that the NRC concur in this request to modify our commitment to install and have functional the ATWS Mitigation System prior to startup from the first refueling outage.

The ATWS Hitigation System is a risk reduction enhancement, and the change in the commitment date does not effect the existing plant margin of safety or provide a significant increase in risk due to plant operation during this time period. With regard to the plant specific design information required by 10CFR50.62. NHY will provide this information no later than the end of the first quarter of 1989.
