SAFETY EVALUATION REPORT: APPLICATION DATED APRIL 29,1999, LICENSE EXTENSION (TAC NO. L31190)
BACKGROUND By application dated April 29,1999, Massachusetts Institute of Technology (MIT) requested that the expiration date for Materials License SNM-986 be extended for five years.
DISCUSSION MIT has requested a five year extension to Materials License SNM-986. In accordance with 10 CFR 70.38(a)(2), NRC regulations allow a five year extension of the expiration date of the license provided the licensee meets the requirements of 10 CFR 70.38(a)(2) and 70.38(a)(3).
Tha NRC staff has reviewed MIT's license file to determine if it meets these requirements and has determined that it meets these requirements as discussed below:

70.38(a)(3)(i) states that an evaluation, or an emergency plan, must not be required in l
accordance with 10 CFR 70.22(i). In the April 29,1994, MIT license renewal, NRC concluded that MIT is not required to have an emergency plan in accordance with 10 CFR 70.22(i);

70.38(a)(3)(ii) states that the licensee must have received written notice from the NRC l
that their certification of financial assurance for decommissioning is acceptable. MIT has entered into an Escrow Agreement with the Bank of Boston to provide financial assurance for decommissioning in the amount of $750,00 for License SNM-986 and the NRC staff in the April 29,1994, license renewal concluded that MIT's financial l
assurance for decommissioning was acceptable; 3.
70.38(a)(3)(iii) states that the licensee must not be listed in the Site Decommissioning Management Plan List published in NUREG-1444, Supplement 1 (November 1995).
MIT is not listed in the Site Decommissioning Management Plan List; 4.
70.38(a)(3)(iv) states that the renewal of the license must meet the categorical exclusion i
requirements of 10 CFR 51.22(c)(14), and that, neither an environmental assessment nor environmental impact statement is to be required. MIT meets this requirement; i

70.38(a)(3)(v) and 70.38(a)(3)(vi) state that the licensee must have been inspected before February 15,1996, and the inspection not result in the citation of any severity level 1,11, or 111 violations or in issuance of any orders or confirmatory action letters. MIT meets this requirement; and 6.
70.38(a)(3)(viii) states that a criticality monitoring system must not be required in accordance with 10 CFR 70.24. MIT meets this requirement by limiting the quantity of special nuclear material to less than the quantities specified in 10 CFR 70.24(a).
ENVIRONMENTAL REVIEW The NRC staff has determined that this revision is an administrative change and will not adversely affect the health and safety or the environment. Accordingly, the staff has determined that the criteria in 10 CFR 51.22(c)(11) for categorically excluding an action from an environmental review have been met. Therefore, neither an Environmental Assessment nor an Environmental Impact statement is necessary for this proposed action.
CONCLUSION The NRC staff has determined that the requirements of 10 CFR 70.38(a)(2) have been met, and Materials License SNM-986 shall be deemed to have an expiration date five years after the expiration date of the current license. Therefore, the license expires on May 31,2004. The NRC staff concludes that the proposed change will have no adverse affect on the public health and safety or the environment and recommends approval of this amendment..
The NRC Region I inspection staff was contacted and has no objection to this licensing action.
