Dear Governor Murphy:

The U.S. Nuclear Regulatory Commission (NRC) has officially notified this agency of the granting of an exemption to Entergy Corporation from certain provisions of 10 CFR§50.54 (q) concerning emergency response planning. Specifically, this exemption allows Exelon to discontinue its offsite radiological planning activities; and as a result, no longer requires FEMA to review, monitor, and report activities associated with offsite radiological emergency planning and preparedness for the Oyster Creek Nuclear Generating Station (OCNGS). The NRC approved the amendments to the operating license that support the exemptions on September 17, 2019.

The NRC exemption documentation states, "Emergency planning and preparedness will be limited to on-site activities; notification of off-site authorities in event of an emergency classification; requiring only on-site exercises with the opportunity for off-site response organization participation; and only maintaining arrangements for off-site response organizations (i.e., law enforcement, fire and medical services) that may respond to on-site emergencies as identified in the licensee's permanently defueled emergency plan."

This letter serves to officially notify the State of New Jersey that as a result of this exemption by the NRC, FEMA's Radiological Emergency Preparedness Program will discontinue all offsite emergency planning and preparedness activities for the site effective immediately. However, as part of our consultation process with the NRC to formalize the decommissioning process and potential associated requirements, we will seek to identify opportunities to assist the state and the involved counties to continue to assure radiological emergency preparedness. Further, the technical assistance provided through FEMA's National Integration Center, in coordination with FEMA Region II, remains available to support all hazards emergency planning and preparedness activities.

I would like to commend the staff from the New Jersey State Police, New Jersey Office of Emergency Management, New Jersey State Department of Health, the New Jersey Bureau of Nuclear Engineering, Ocean County OEM, and the Oyster Creek Emergency Planning Zone (EPZ) communities for their dedicated participation in the offsite radiological emergency
